Was she the subject of a custodial interogation (no, I didn't watch the vid)? If not and she was just running her mouth, she doesn't get read her rights under miranda.

i don’t recall the Officer reading her her rights after telling her he was arresting her and to keep her arms behind her.
also, she is clearly not with it… Totally impaired… And the officer is asking her a ton of questions to get her to implicate her self further for the court case.
He’s incredibly professional and doing a great effing job, but I do wonder if an attorney can’t get her out to do that.

I have a friend who was not read his rights in a very similar situation, attorneys say that doesn't really matter anymore....WTF??
He certainly should not have been doing what he was doing, but there are Miranda Laws for a reason.
Miranda absolutely applies... Not sure who the above attorney was... We do some defense work...mostly federal but needless to say from watching this video that officer may have some issues. If the officer questioning implicates your involvement of a crime Miranda applies. They can try to claim spontaneous utterance but... that is not the case from this video. The other issues is if Miranda does not apply... and you are not making a custodial arrest you start getting into issues of 4th amendment seizure issues.
I will say this. The officer was outstanding. Very good attitude...but... He knew from training there was something up with her. He and others are soo much better off reading Miranda and protecting themselves and their agencies from liability.

That whole thing is bad but I am sure the Officer did what he had to with all things considered to keep his place in line but I do think it showed how enforcement has Laws for thee, but not for me.

That video pales in comparison to the Aurora, Colorado Police Department high end Police Officer found passed out drunk on duty in the middle of the street, in a Police car, armed and ready, car in drive and running, foot on the brake, with lots of other Police Officers and EMTs with bodycams around and their audio on file, yet He walks with no DUI???
Footage of the Chickenshit DA explaining it all but not Per Se or whatever, nor subeonas and all of that shit?? The Officers walk.
And you Wonder why I don't Trust the System? Maybe they need a Grand Jury to investigate ALL involved? and take a few pensions away?

Remind me to tell you about the time I got arrested because I was speeding and the officer couldn’t tell the difference between my car, a Ford escort GT, and a Ford Mustang.
Needless to say, well at least six other patrol cars showed up to the site, and they realized that I was not the guy he told everybody they were looking for… They made an awful lot of fun him...
I had to go through a lot of crap as a local court was trying to protect the officer… But on appeal, the appellate court through the whole thing out because he never gave me a ticket and he lied and told him he pulled me over because I was the person they were looking for.
It’s shit like that that makes you want to answer the door with armor piercing rounds. Don’t get me wrong: I absolutely set up the circumstances to be in that mess by going 25 miles an hour over the speed limit at 10 o’clock at night. However, from start to finish it was all about that department and township court trying to cover that police officers ass, as opposed to being honest from the beginning.
The one thing that drives me nuts is that the police can lie to you, but it’s usually a crime for you to lie to them.
This lady is 100% responsible for the situation she’s in... i’m certainly not gonna cry for her or believe the police were screwing her....

Yeah, there's a good video of one of the assbag, commie democrats in VA getting pulled for being drunk at the wheel. Guess what, by law, delegates can't be arrested if gov't is in session (at least for dui). WTF! Their politicians pose more of a danger than all of our armed brothers who showed up there a couple of weeks ago.
