FIRST: Panty 6 is a tough motherfucker, she is as she says, ok. A few rather nasty headaches, post concussion, a really beat up shoulder, but a few pills and she is still saying she is fine...but the strength of the headaches, and the tenderness of that sholder belie her words. It has taken me a monumental amount of work to finally get her to make a doctor's appointment to get a full evaluation with a follow up within two weeks or a month.
She was merely awaiting the black Sentra to go by so she could safely make her right turn onto the main road.

This is pretty much what she looked like before the 29th, 1605 hours

Then this DC with CRAP GEICO insurance(FU GEICO!!!) makes a VIOLATION OF RIGHT AWAY left turn, in front of a black Sentra doing 45mph - 50mph when the Sentra is AT THE STOP LINE(Did I say doing +/- 50mph)

This is what (FU GEICO) Geico says is over 74% and wants total loss on(Vehicle is a SOLID $5500 - $6500 all day long, in every state since it has the 'high end' parts, ie, 4.08 LSD, Moon Roof, Superb Interior, Cruise, OD, 'crackless dash', Nissan sport tuned suspension(factory)) Last I checked, 75% of a solid car value is well over $4111, and therefore not a total loss, especially when the body shop says it can all be repaired and replaced back to OEM working, SAFE functionality.

Now STATE FARM, a superb insurance company, gets to get involved in this since the DC driving the Caddie SUV had the bare minimum by TN standards..stupid trailer trash DC...motherfuckin trailer trash SOB husband, b/f, whatever had a damn bucket out, collecting any and all small parts he could find, adn all I have wanted to do since then is choke the living daylights out of that stinkin bitch
Pardon my colorful language as it is rather crass, but so deserved.



I am now, within the next few days, going to call Progressive, and All State, adn State Farm to see who will insure my two bikes cheaper or better than Geico...no more of my money s going to that scurvey little green fucker...besides, FLO is so much more fun

First, we do (and will continue) to pray for [Mrs. Blade]) for her healing. No question.

Secondly, as I too have been 'up against' the insurance company since '04, I do know that it is not fun, nor is it easy at all.

The only thing worse than a 'defense lawyer' is an 'insurance lawyer'. They have flocks of these bastards just sitting around trying to think of ways to screw their "customers" out of any contractual obligations and liabilities.

Make sure that you Cross your i's and Dot your t's as you progress with this. Drag your Lady, even if she's kicking and screaming, to a doctor to get checked out. Maybe xray'ed even.

I have experience with things healing 'wrongly' from the so-called 'experts' deeming things 'within acceptable standards' (sic). Getting screwed for life is something you want to head off at the pass. Do it now.

As an LEO I was in more than my fair share of traffic accidents, one was a double fatality, not my falt.

Do not pass go, head straight for the lawyers office and tell them to handle it and real swift like. Sign nothing, do not, DO NOT try to work with their insurance company, you'll get the hose.

Judging from the pics Panty 6 will be fine. She's married to you and she'd have to be tough and hard to handle that

Glad to hear Panty6 was not seriously injured. There is always the chance of underlying issues as you are well aware and good job on making her go to the Doc.

Good luck on the insurance battle and hopefully it will get resolved quickly and to your satisfaction. A lawyer may not be a bad idea in the current situation. I am guessing she refused medical treatment on scene and while that is okay it can also create issues later on if she goes to the Doc and they find something or end up treating her for an underlying injury. Insurance companies are rotten and will look for any way they can to deny medical claims!

As a fellow recent car accident victim, I wish your Panty6 a quick and complication free recovery. i also second the sentiment to have a lawyer go after the other driver's insurance so you can focus on ensuring the Mrs. heals well.

Sounds to me like she has a SERIOUS case of whiplash that can only be cured with years of therapy and a large settlement. Just sayin'.

Talk to your attorney before you speak to anyone else Switch, especially insurance companies. You are obligated to cooperate with your own insurance company up to a point. Your attorney can guide you on that point.

Again, glad Mrs. Blade is as tough as you describe!

It will be less expensive all the way around, better service and easier to deal with and every year with no claim you get a rebate check.

Switch, Glad to hear Mrs. Switch is OK. Thats the important part. I had progressive for 7 years, I hit two cows while I had them (act of God as the called it) they did NOT HESITATE to fix the truck. That being said, I paid double what I am paying now with Geico. I left progressive because their name coincides with their politics. Good Luck an stick it to em.

Do you or the other driver have Geico?

We as a couple, me as a young Marine, started with State farm back when USAA was only a insurance company trying to screw Soldiers. We have since then had insurance for home, vvehicles, any rental(ie mil -spec housing), and any other insurance needs with State Farm for 25 plus years. The only reason I have Geico on teh bikes is because it has towing coverage vs State Farm not(we are now rethinking this). We have a long history of a series of discounted prices since we have been with State Farm as well, adn have never had any issues with them or their coverage, or reactions in any accidental involvement(I had a Trailer trash Mf'r brake check me on a road and try to claim I rear ended them and broke their bumper, but the bumper was already broke from another impact, and State Farm found they had a small history with rear end claims and also found evidence that they would do this about every other month...scam)
With multiple vehiclle discounts, home, and property all tied up with SF, we are ok with them. To switch to another company at this point in time would more than likely have a large forecast cost due to not being a 'loyal' customer for so long.

As to any lawyer involvement, I am at this point handling this with the advice of a very expereinced individual who knows these things inside and out, and who also has a good idea of what to expect in this stuff. An attorney, once involved will require 30% - 40% of anything, and the insurance companies at this point in time have a record, when they do the right thing, of actually paying out the same thing an attorney would get you(aforementioned is the view of this individual and very accurate as it applies to my case at this time) Although I woul dlove to walk away since I am neck deep in Chemistry summer classes and let someone else do this, I have to handle it myself.
I would entertain any ideas as to USAA and how they would be able to roll up ALL my stuff into one program for a lower monthly though

Ya'll really should count your blessings and 'get into it deeper' with your insurance down there. (In general, that is) Up here we have one single government mandated "No Fault" insurance with no other options.

Switch, you sound like you have a good handle on things. I do pray that it (the handle) is as good as it sounds.

And may ya'll never go the route that 'they' did up here.

Glad your lady is ok, and while it isnt much, there is a bright side, at least the other guy HAS insurance. Could have been the border-hopping day laborer driving the 85 Toyota "whatever" pick up that ran a red light and t-boned my friend while he was driving his Roush Mustang. Total loss, concussion for him, broken arm for his g/f, almost 4 years ago and he still gets headaches from it. Bout all that was saved off the car was the engine that he sold.

It really sucks, but it could be worse.

At this point with the new knowledge I have, uninsured would have been preferable as State Farm would have handled it from teh beginning, and the SUV owner would have been charged with several other counts. I really have to laugh. It seems Panty 6's boss suggested a tax and property search based upon the information given in the PR. Name, address, etc are all there. SUV owner owns one piece of property with a trailer on it(trailer park address) and another piece of property with a small home on it. I had a bit of a laugh yesterday when someone said,"We will probably end up going after the properties in this matter to recover teh funding to cover the underinsured coverage."
And of course, again, I am now hearing the willfull, hard headed, obstinate, stubborn, "No, I am not going to the doctor, I am fine!" as she heads to the cabinet to get either tylenol, or the stronger codiene. Is it within legal limits to bind, gag, and transport her to the doc unwillingly? Can I not do this as a concerned husband without facing felonious spousal abuse laws, kidnapping laws, and illegal transpot etc., type laws?
I do know of course this is the exact same thing she hears from me as well in similiar situations...

Switch, as a bodyshop owner I will tell you to break out a sledge hammer on the insurance companies. Yes, I said companies. First off, they have NO legal right to tell you to take it here or there. By federal law that is "steering" and they cannot do it by law. Record all conversations. Second, if P6 was not at fault, they cannot total your vehicle even if it costs 50k to repair. In a no fault state its a little different. If it were me, I would get three of the highest estimates that I could, make them copies and let them pick how much they want to pay to repair your car. As for P6, she needs to see a doctor and file a claim against all involved. Most insurance companies have a UM policy ( uninsured motorist) at around 40K per incident. To press hard you will need a lawyer but if you have more than one vehicle at fault or involved you can and deserve to be paid by each one. Good luck and let me know if you need any info to proceed. Also, I hope P6 gets to feeling better and drag her ass to the doctor! lol!

Apparantly TN has an insurance based law that if damage meets the 75% Market Value then the vehicle can be totalled, but we are pushing for repair since Panty 6's vehicle was the only one not moving and innocently just sitting there waiting. Panty 6 was not at fault, and to the point was sitting quietly awiting either teh green light, or a very large break in traffic to effect a legal right turn.
As of today, the car is being collected by a new body shop, one with much more integrity than the other, and my insurance company is starting the entire process over; and that, with the knowledge that my working stance on this claim is being directed with advice from someone who holds an experiential level way above all of their collective heads to point me in the right direction.

I called and spoke to USAA. They cannot meet, or beat the coverage, or the price of what we pay State farm, and receive in return. 25+ years of loyalty does offer some discounted reward I guess. I have also requested a quote to essentially cover all my stuff under one umbrella with Farm Beaureu next door to our credit union. Initial assessment though, is no one can match the total package cost, nor the total replacement values to the really important stuff since we have been with State Farm, and have everything but umbrella coverage(that would be our true next step for coverage at this point in our lives). It's just looking like my 30 years and our 25 years as long term customers does have certain advantage that has resulted in the building of a very nicely set up comprehensive plan. The deal on the bikes is that Geico covers towing, rental transportation(car if the bike is an accident victim) and overall full coverage for about what State Farm would cover only the bike itself for

But more importantly, has Mrs Switch been to the doc's, yet? Hopefully so, and what was determined? THAT is the important'er thing!

Grrrrrrrrr rackin frackin hardheaded, stubborn, obstinate, willful...She was supposed to go to be checked out, I found the place/Dr. for her to get the appointment and of course,"I'm FINE, I don;t need to go see a Dr, Why should I see a Dr, I'm FINE" Little Miss Hardheaded PITA Panty 6 was dazed, not confused, but bell wrung dazed out for ten minutes + after the impact. "No, I didn;t get a concussion" Uh hello, you were dazed out after teh impact, that my dear IS a concussion...I think it best to just let this one go before she really gets evil, or maybe wait and knock the other side to make her even again
