Suppressors Can a trustee add items to my trust?

My brother is a trustee on my NFA trust, he is wanting to build a SBR and possibly a suppressor. Does anyone know if he could add it to my NFA trust as a trustee, or does he need to start a trust for himself? Also, he lives in another state. If this were all to work, could he keep those items in his state or would they have to stay in the state where the trust was made.

If the trust grants him the power to manage trust assets then yes, he can add items. The out of state thing is an issue because the trust state is the 'home of record' for the item. He might have to have it delivered to you and then submit the transfer form and mark it as 'permanent'.

It's a revocable trust.

He can add to the trust if he is a trustee and living in your state in which the revocable trust was formed. Out of state means he is out of luck.

Thanks for the info fellas, We were just trying to reduce hassle and more money and paperwork and just have 1 trust for all of us. He just signed up for another 5 years, so I don't see him moving back here until he decides to get out.

This is not legal advice.

Even in State, the answer would most likely be no.

The reason being that the Trust could be "revoked" by the Settlor and thereby deny the gifting Trustee access to the very item he brought into the Trust.

Bad idea.

look through the language in your trust. mine states that i am the only person who can add items to it. once added, i get it re-notarized and im good to go.

in your situation, i would have him do his own.

id consult the person who did your trust and they will give you the 'right' answer for your case.
