I got my pre-approval form 4 back (as in still needs CLEO signature) and my SOT dealer brought up a good point. I live on a military installation, and they stated that the CLEO for my area would be the Security Forces commander.... with that being said, I was going to have the state troopers sign my form 4 due to the fact that they are a statewide recognized law enforcement agency, and the Military commander is well, lets just say, not. Would the ATF recognize the security forces commander if i could get him to sign? or should I press through with the state troopers?

A state trooper can't sign the form. You need the Chief Law enforcement officer of your county that you live in.

It has to be a chief law enforcement officer. I dont think a trooper can do it. I would go with your SFC or the commander of the state police there or sheriff of the area the base is in.

Set up a trust that includes family members that you actually trust. If uncle sam sends you to CA or IL for your next duty station you will be able to leave the supressor with any member of the trust.

eta: The other advantage of a trust is that there is no CLEO signature requirement.

By state troopers, I meant their captain, the trust is kinda out of the way seeing as I am broke.... the only reason why i don't want to go with the SFC is I don't know if the BATFE would recognize him as an actual law enforcement officer, whereas if I went with the captain of the state troopers, I know they will recognize him, as my SOT dealer has had him sign stuff for them, they just happen to live off base. Also, because the state troopers (and their captain) happen to be the highest of the state law enforcement I figured that they would cover all the areas of alaska.

If your dealer told you the captain has signed them before then i would go with him!

if you're broke...why are you buying NFA items?

and also, what does being broke have to do with setting up a trust? My trust cost me all of $0 to setup......not sure how affording a $200 tax stamp and ANY NFA item can be cheaper/more affordable than $0...

You have to go to the county that your installation is in and get the Chiefs signature. You could call the ATF and see if the Provost Marshal could sign off on it since you are on a federal reserve.

i just took it to the captain of the troopers to sign, the atf will recognize him as a CLEO, i don't think they would go for the SFC

A trust is pretty close to free. Just cost of some paper and ink to print out.

1. Get free trust document.
2. Fill in names and signatures.
3. Make copies.

I'm not too sure about this state,(AK), but the lawyer I spoke with in North Carolina wanted to charge a hefty fee to draft the trust, it was about $400.00 due to the "labor" of writing it, or drafting it (figured he was just trying to screw me out of some money). I also read about the trust software that you can get for your computer to set up wills and what not, but there was some negative feedback on the validity of those trusts when pertaining to firearms. I would rather not go through the hassle of obtaining a suppressor only to find out later that I am in violation of tha NFA due to the trust no being valid. When I can save up enough money to, I plan on having one written for future purchases. Not to mention after hearing about what some of the ideas were for future plans the trust seems an exponentialy better idea. heard about the possible changes in the video on this thread:

Unusual that the State Trooper boss signed, but good for you.

The Security Forces Commander has technical (federal) jurisdiction on-base.

As a military man you'll just submit a change-of-address letter when/if you PCS or retire out-of-state -- trusts complicate moves because they may be valid in the state established in, but not the state you're moving to.

I would make sure that you have a valid reason for using a trust.
My use was to be for in the event of my untimely death, but I found out that a descendant could just file a form, so no need for a trust.

I submitted to the Captain of the troopers, I haven't heard anything back, if he kicks it back I guess I'll have to take it to the SFC, I wasn't aware that the BATFE would consider him an actual law enforcement official

Mall Ninja, do you reside off base and carry an Alaska driver's license? If so, you should go to the Chief of Police at North Pole, if you reside in North Pole.

Guys, there are no counties in Alaska. Our county is the village, borough, town or city we live in.

I just got a signature from the Anchorage PD Chief. However, I am not military. It shouldn't matter unless you live on base. In that case, your Provost Marshall should have the answers you need.

Correct. If you're military and bust the Uniform Code of Military Justice on-base you are arrested by the military law enforcement guys and prosecuted by the General Courts Martial Authority. If a CIVILIAN busts the law he might be arrested by the military law enforcement guys with on-base arrest powers, and prosecuted by the US Attorney's Office with a federal magistrate presiding.

OP

You need to have your local (civilian) CLEO sign your forms...or establish a trust. I'm a graduated Security Forces SQ/CC...and the NFA/States NFA requirements are not, and won't be, a concern of him/her. I had a trust drafted for my NFA items with co-trustee (family member in an NFA friendly state) identified so when/if I'm PCSed to a non-friendly state the co-trustee can maintain and utilize the items per the trust without any legal hassle. Either way, the BATFE will need to be notitified when the NFA items leaves the state for another location. If you live on base ensure those items are registered, along with your firearms, per AFI and any location installation instructions. Off base...no issues.
