Anyone know about writing a bill of sale for a firearm purchased out of state. DO some states require this? I sold a old norinco 1911a1 to someone and told them to send payment and FFL. They are requesting bill of sale. Only bill of sales I have done is over vehicles where both parties sign and both get a copy.

They probably want something in hand to prove where they got it, however they can get a receipt of purchase through the FFL they use. That would be more legit and more credible then something from an individual I would sure think. Any issues with it with getting stolen or whatever will go back to his FFL anyhoo.

Anyone can write a bill of sale on a piece of paper. It simply states that you sold and received payment in kind for X on X day and time. It also allows the receiver to show the purchase was indeed legal in all respects

Not a requirement. I've seen this employed as a means to gather you're personal information just in case there is an issue. "Sold As-IS" is the preferable choice. Once you receive payment, and the weapon clears his/her FFL, I don't see the attachment unless the weapon was delivered in a condition other than stipulated.

I agree that it isn't a requirement and unless it is going to jam up your deal, I personally wouldn't do it just because someone asked.

If you proceed, here is some basic language I've used in the past on other purchases/sales:

I______(seller), in consideration of the sum of ________dollars($_____), do hereby sell, transfer and convey to ________(buyer), the following firearm:

[INSERT DETAILS ON SPECIFIC PISTOL/RIFLE/SHOTGUN HERE]

I the undersigned seller agrees to sell the above described firearm to the buyer for the amount shown above "as is" and without any expressed or implied warranties. I agree that all statements made in this bill of sale are true to the best of my knowledge.

I the undersigned buyer accept the firearm "as is" and acknowledge this receipt and accept that there are no expressed or implied warranties, with respect to the above described firearm.

Said firearm shall be shipped and transferred from the seller to the buyer, in accordance with Federal, State and any applicable local laws. The buyer has provided the follwing name of a licensed Federal Firearms Dealer (FFL) in his area who will undertake the legal transfer (including necessary paperwork and background check) of said firearm to the buyer:

[INSERT FFL HOLDER'S/TRANSFERRING AGENT'S INFO HERE, INCLUDING HIS FFL #]

Accordingly, the firearm in question shall be shipped to the aforementioned FFL in the manner agreed to by the seller and buyer.

Dated this______day of_______,2012.

Seller Name:___________ Buyer Name:___________

Seller Signature:________ Buyer Signature:________



Again, this isn't necessary and the above format is just a quick and dirty sample. Use it at your own risk/necessity.

Some states require sales tax to be paid for online purchases. These are collected at the dealer. They may just need something stating a value so they know the amount of taxes owed.

A written receipt is what protects you 'in the event of'. It shows you have no further liability on the date it left your possession if it was in good working order. It also shows the transfer was as legal as it could be from your end.
