You cited the definition of a weapon - not what context allows for "Lethal Force". (May want to review Chapter 9). Also may want to consider that the US is bigger than Texas - so blanket statements aren't always the best.
http://www.statutes.legis.state.tx.us/Docs/PE/htm/PE.46.htm Furthermore in perusing Chapter 9 - the act of simply being sprayed with 'Bear' spray (because we want to eschew technical terms like scoville units per OZ) - doesn't allow another to justifiably use lethal force.
Last thought - and it is one for you to ponder - exactly how does one know if they were sprayed with 'Bear' spray? Wouldn't the fact of the matter be that few people have been sprayed with both pepper spray and 'Bear' spray (I love that term) so as to be in position to distinguish which is which - and by extension, as based on YOUR interpretation of Chapter 9 - when they are justified in using lethal force?
