Get this. A guy shops his car, a gleaming, top-end, barely driven Camaro, for a minor paint job, and a service writer decides to go in on Sunday and sample the goods. He winds up wrapping it around a telephone pole, the dealership phones the owner and tells him of the incident, and then tells him that there's nothing left to fix, that it's absolutely, completely totaled — and then they tell him that they're taking no responsibility for it, whatsoever.

They ran it on the local TV news tonight. The car looks like it went through a grinder, literally.

Owner files claim through his insurer who will then likely file a claim through the dealership's insurer.
It then becomes a battle of the insurers and the car owner screwed out of his car until its completed.
 
and then they tell him that they're taking no responsibility for it, whatsoever.

Most likely the owner had insurance, and if so the insurance company will pay the owner and sue the shop. The owner can take the shop too small claims for his deductible. The main lesson; do not let some fly-by-nighter work on your pride and joy.
 
I know that the owner will ultimately be indemnified, but it's the brazen attitude of the dealership (not to mention the service writer, when talking to OnStar and the po-po on-scene) that amazes me. It's an expensive hit to take, but it's cheaper than losing the trust of the public.

a few years back a buddy worked at a tire, brake, lube type of shop in the high end of town,guy brings in 911 turbo
high dollar something or other with explicit instructions that only the service manger puts it on and off the rack only, and
that he will come back for test drive with manger. well 2 of the "mechanics" thought it would be ok to do the test drive
after the install while the sup. was at lunch.yep you guessed it while testing for tire vibration at 130 mph they lost it and tag
the jersey barrier .some how they didn't total it,and passenger runs back to the shop on foot like every thing is ok, driver is with
police trying to explain what happened.service manger goes over to the scene fires him on the spot he narks on passenger he gets
the ax.
owner shows up manger explains what happens and tells the owner that he will get a estimate to fix the damage,
wrong! owner says NO you will by me a new on, shop owner shows up and has same song and dance about repairs,
porsche owner says nope new one,a hour back and fourth arguing 911 owner finally drops the bomb on them,he is some very high end attorney,
week later he is driving a new porsche. :)
 
I hate lawsuits but the Service Center attitude is asking for a civil lawsuit. They can loose much more than just the amount to replace the car.
 
Just look at the dealer ratings...that will show you how much trust the public has in them...How do they stay in business?
 
the shop owners best bet is to have it repaired and sell it.. in hopes that it will cover the majority of the bill. I hope he was carrying the proper insurance

My experience with financial mediation is that when the dust settles, it's always gonna get split down the middle, and then the Mediator slams down a percentage to both parties 'for services'.

I would suggest that all parties involved be sued for criminal negligence with punitive damages. No matter whether or not the mechs were fired, their actions are attributable to their employer at the time the incident transpired.

They should have been taken off life support last time. Hopefully, there's a DNR order on them this time.
 
Car Insurance follows the driver,not the car dude who crashed it will eat it. I'd also be inclined to look at criminal charges also for unauthorised use. At least that's how it would work in my neck of the woods. Maybe Gas Monkey will fix it and sell it LMAO

I've had a $6.7M business jet with very few hours on it need a paint touch-up...so I guess I don't see the issue with it, especially not knowing the circumstances.

If you read the story, apparently he had custom paint done on the car, and the custom paint was peeling.
 
Dealerships in the Northeast must be different than they are around these parts.
The ONLY paint or body work that one would have a dealer do around here would be warranty coverage.
Even then, the dealer would farm the work out to a local P&B shop, as they are not equipped to do it themselves.

Dealership is trying to fuck him.
I show up with my car and ask for work done, if I show up two days later and get a heap of scrap it is on the dealership to make it right.
If you make a claim on your insurance it will RAISE your rates. I was rear ended by drunk drivers twice and it raised my insurance rates.
 
Several if the dealerships here have their own paint and body shops.

I made the mistake of have body work done at a GM dealership, once. All the talented paint and body guys either own or work at premier (non OEM) shops.
