I do not know if he can appeal the original case, but unless he changes that outcome, from here forward the merits of the case are based on the existing ruling if my understanding is correct.

i think you missed the point of their case - he accused them of being in a conspiracy and being actors. It wasn't "they were bad kids and deserved to die". This isn't a 'he said nasty shit', it's defamation. Also, because of his defamation, the parents had people target them, send in death threats etc. There's a difference between losing family and then made to eat shit for it because someone else murdered them.
