The "It's not a suppressor, suppressor.

I can see the Feds making an argument that attenuating the dB of sound emitted - regardless of design - is the same as shouldering a brace or holding a rifle loosely enough to increase the speed of firing. They want any excuse to be heavy handed in enforcing their rules while pretending they are laws.

They can try but if the sound is not appreciably reduced they do not have a leg to stand on, it when has it stopped them before? Nazis are gonna nazi

Only way to not be at legal risk I see, is if it simply dosen't work. Just another forward blow that will bounce that sound right back at you as soon as you are not in a giant open field.
 
I dont think the ATF has a minimum standard, I believe any reduction especially if advertised as a sound reducing accessory.

When Colt sold the 639 M16's with the moderators, ATF said they reduced the sound 1-2 dB. ATF required a recall on all the moderators or you had to register them as NFA. Many just got tossed as people didn't want to pay an additional $200. Years later when test equipment got better I read that they actually increased the dB by 2-3 points.

Heres a great idea, produce a device that "mitigates" sound, of course not "suppressing" sound, then advertise it online to millions and then sell it. Whats next, stamped metal cards to make your gun full auto, being sold as "AutoKeyCards".

There's already some arguments and legal theories that could be implemented if President Biden wins again that states that any constant rearward pressure on the trigger to fire a gun constitutes that gun be classified as an automatic firearm. With the Hughe's amendment, that would completely ban all semi auto firearms made post 86
 
Same concept as the Surefire Warden, similar but different than the Noveske KX3 or 5 that lacks a muzzle brake, both of which have been out for years (the Witt isn’t new either). They don’t reduce dBs and are pretty far from being in any sort of gray area. Doesn’t mean they won’t change the rules in the future, bureaucracy being what it is they can and will create their own laws at will.

None of them eliminates the need for ear pro, even most suppressors don’t either shooting supers. Take your hearing seriously and stick some plugs in your head.

Otherwise, having only a brake and nothing redirecting the blast just means people won’t crowd you on the firing line. I don’t see any problem with that, not to mention not introducing yet another variable that can affect accuracy.

They should have one of their top agents stand right in front of the not a suppressor, look down the barrel, and someone fire it. Then he could comment objectively on the sound reduction...or lack there of.
