WTF? Can someone point me to the part of the Constitution that supports this claim? Because the version I'm working from basically gives the government a short list of permissions and tells it to otherwise fuck off. "Entrusting my safety and health" is not on that list.

10th Amendment. Any power not specifically enumerated in the Constitution to the Feds is the purview of the states.

I love me some 10th Amendment. IMO, it's the most underappreciated.

But it ain't a prescription for petty dictators at the state and local level to trample upon rights that are explicitly enshrined elsewhere, and implicitly protected by that whole concept of life, liberty, and pursuit of happiness.

Both sides would agree with this statement.

Conservatives would say it isn’t to be regulated then if it’s not mentioned. Liberals and tyrants would say that what the feds don’t control its up to the states to regulate all the rest so that 0% is left unregulated.

See the difference in outlook? That’s the mindset you’re up against at the local and state level in NY and almost everywhere else.
 
And another thing: you know when any judge knows they are making a shit ruling when they talk about something “in principle” instead of quoting laws. You also know that how they are intent on writing legislation from the bench
