Does anyone know of an attorney in the Houston area that can do trusts that is familiar with firearm laws?

I just figured it would be best to have an attorney draw the paperwork up to the ATF standards. I have a Sheriff that will sign off on stuff, however would like to bypass that and be able to keep my stuff in the family. Can yall recommend where I maght be able to find the materials to get it done, and I guess you would need to file the trust with the District or county clerks office?

the paperwork to ATF standards is already there, online

keeping stuff in the family is splained to you also.....atf standards and all, online

trusts would need to have a notary....go see you local bank teller

boltripper is right, i didnt know jack about it , cant read legal jargon , but the class 3 dealer walked me thru it and answered all my questions find a dealer to talk to .

consult with an estate attorney. Most of the trusts out there are completely invalid. Obviously the NFA doesn't know enough about them.

I'm sure there are 1000s of trusts that are invalid out there but will that mean some day they all have to return their stuff. Doubt it.

Be informed.

one simple way to invalidate a trust would be not purchasing the can via the trust. If you already own it then it could be put into a trust by assignment etc. But define ownership to the NFA is it equitiable ownership or legal ownership or both. Gets really grey really fast.

another simple way would be to not include the words "joe bob nfa trust dated xx/xx/xxxx" I could make a trust named joe bob nfa trust every day of the year but it's the date that you start it that counts and separates it from any other trust.

another simple way is to not pay the 200 tax stamp via the trust. You send them a personal check. Or money order with your name joe bob" on it instead of the trust....filled out payer: Joe bob nfa trust dated xx/xx/xxxx

furthermore a trust is for sure not valid until it's funded. Yes you can go to the bank and noterize it etc etc. But until it's funded it's NOTHING. You fund it in your declaration of trust. NOT with the damn NFA weapon cuz you don't have legal title yet. so how could you assign it???? You fund it with cash or start a checking acct.

I'm sure all the legal arm chair experts will flame me on every point. But the truth is you need to consult with a good estate attorney that specializes in trusts etc.

Or you can half ass it and go the quicken route and I'm sure you'll be fine.

My choice was I didn't want to chance it that I would be just fine. Luckily my friend is an estate attorney of 25yrs. We went through the laws and case law and came up with a trust. He looked at the other trusts people are typically using and laughed his ass off. Said these wouldn't hold up in court for 5 minutes. His services were free to me so he wasn't trying to sell me.

Most of what you state has nothing to do with the trust itself but rather the process you use to register the NFA item. Just because you screw up the paperwork for the NFA item doesn't mean the trust is invalid.

You don't create the trust with your first NFA purchase, you add your first NFA purchase to the trust.

As a grantor/trustee of the trust I can act on behalf of the trust and write the check/money order any damn way I want. That's why the form 4 is signed as "trustee."

If you know how to read and comprehend what you are reading Quicken is an acceptable way to create a simple trust. Any extras added by an attorney are additional details to be questioned by another attorney at a later date.

If your trust complies with the legal requirements of the state in which it was created it is a legal trust. Every state is different and has their own laws pertaining to trusts.

Holding up in court is something for the heirs/beneficiarys to argue about. As long as the grantor(s) is alive and it was a legal trust it'll stand.
