Good morning folks, I have a question one of you may have some insight into.
Scenario
There is a nice BLM plot that is near some friends of mine, and it looks incredibly convenient in terms of proximity/ease of access. There is a problem though, it is fenced off. Not "it is surrounded by private land, and fenced off", it is literally fenced off from a public road.

I've attached the OnX birds-eye view of the area (it's in Pueblo CO, just south of the reservoir/river feed. I've also attached google street views of that public road, showing the fences on both sides of the public road, blocking off access to the BLM area.

Is there any way that fencing off that area from the public is legal?

From my experience its legal and it's not to keep you out but control animals. Everyone I know would cross it but if your concerned just check with a local BLM office.
This was my thought as well. Awaiting office opening now though, so that I can call and check before I tell one of my pals to go potentially trespass.
 
It looks like that fence, barbwire apparently, is there because the BLM leases that section out for grazing. It simply exists so that cattle are kept off the road. You could easily access it, but it would have to be strictly on foot. If you’re not lazy, those kind of spots can be awesome for hunting.
 
Yes, BLM fences most of its land for control of animals, to stop illegal dumping and assholes with ATV's from driving or electric bike pricks from riding all over it. Don't want the neighbors grazing it? Fence works.

I've rarely seen BLM without a fence, but most is also leased for cattle grazing off and on. Fully legal to cross fences on BLM.
 
My immediate thought was BLM people carrying foils and sabers and saying "en guarde" a lot.

Then it was about fences, and it would antithetical for BLM to build fences because that is actual work, to which they are allergic.

Yup each BLM district office is split into sections. Each section will be assigned a specialist. Find out who that is, and they can help you out. The AFM (assistant field manager) should be able to help you too.

Now that you are out west, read up on BLM and how it works. Its worth your time to learn the rules and how to navigate them to find good hunting and shooting/rec spots.

They are probably the hardest if not one of the hardest working agencies out there. Most of DOI is. I know of all the places I worked, they were by far the most impressive, hard working and ethical people I have been around.

But please go on about things you know nothing about. When a guy making $12 bucks an hour ,living out of a truck and hasn't been home in 3 weeks saves your community from a forest fire, you can tell him how lazy they are. 90% of the members here couldn't even pass the basic test to get their red card.

If you find a public bathroom or porta-can, there is usually a shortage of toilet paper. So close, yet so far....

The one I hate, is chained and padlocked gates on BLM ground. I may or may not carry bolt cutters in my truck for such occasions. There are more than a few cattlemen who think that a grazing permit on BLM ground is akin to owning it and restricting access.


IN my experience, nearly all the fences on BLM property are for keeping cattle contained in grazing areas, or they're old fences that were there when BLM acquired the property. Mapping programs using publically available data are pretty good at providing accurate maps, although I always recommend using 2 separate systems to confirm.

Locked gate? Call the BLM. It's a crime to obstruct transit across public land or put a fence up unless its authorized. Unless of course it was BLM that put up the fence or locked the gate. Usually they put up a sign.
