Mail it to them with a note about what is wrong with it, you should get a new scope in a week or two.

I think it is the 9x36. I bought it a couple years back but was scared to stick it on any of my heavy recoiling stuff so it sat in the safe. I recently stuck it on the 223 FTR rifle that I built for my nephew. Actually I just pointed mostly, and he did the work, and did not do bad for a 14 year old. He used it in his first match and started having scope problems.

A friend of mine had the same problem with his 9-36 is why I was asking.
My friend sent it back but it still retained the problem and ended up trading out a IOR 6-24 SFP instead.
