Please forgive me if this is a dumb? but I just started here. My buddy is trying to sell me a pvs-14 mono scope, but it says U.S. Government Property on it,he's in the Army. Is it legal for a civilian to own something like that?

Re: Is it legal to own optics that Say U.S. Propery?

If it is Government property he is committing a FELONY. If you buy it you are receiving stolen government property, also a felony. I don't believe that they remove it from service and resell equipment as it may end up in enemy hands, or the drug cartels. Tell him to give the shit back or smash it in a million pieces and commit to never stealing again.

Re: Is it legal to own optics that Say U.S. Propery?

Dude.....run away from that as fast as you can! The only way military NV gets into civilian hands would be through a government program for LE Agencies....

Re: Is it legal to own optics that Say U.S. Propery?

I would stay away unless he has documentation with it. Sounds too much like “lost” property...

Re: Is it legal to own optics that Say U.S. Propery?

That was my first reaction and I asked him if it was stolen. He said no it was not and he would give me a bill of sale for it. Either way it doesn't sound good.

Re: Is it legal to own optics that Say U.S. Propery?

Point is you can find them for $3K to $4K but you say it says "Property of US Government" they don't give that stuff away.

Re: Is it legal to own optics that Say U.S. Propery?

The government auctions off property all the time, it should be easy to find the auction paperwork.

Re: Is it legal to own optics that Say U.S. Propery?

how much does he want for it?

Re: Is it legal to own optics that Say U.S. Propery?

Yep it Said U.S. Government Property on the housing. By the way I like your first response,"Tell him to give the shit back or smash it in a million pieces and commit to never stealing again." I dont know how you could get something like that off a base. all I know is I dont have a record and I dont want one.

Had a Navy SEAL selling hand grenades and C4 just a little while ago. Maybe a year or so? You only get your I.D. checked on the way in, so it is up to your conscience to not steal.

Re: Is it legal to own optics that Say U.S. Propery?

Yes, it is legal to own them. tens of millions of dollars worth of govt property is sold every year (if not month), contractors often have over runs, and some of their products do not pass final inspection etc., unless it is a "special item" they sell them. Is it legal to own a firearm that is stamped US? Hell yes. Or a truck, jeep, etc. etc.? Yes. The marking of something U.S. prop does not make it illegal to own, and it is sometimes used by mfgs. to "increase" the value of their products. An example is the use of "contract over-runs" with certain scopes. Years ago, a company that had actually made the packing case for PVS-5s (the smaller case that went inside the large case, for those that know)sold a lot of those cases, marked U.S. Property, any law against it? Not that I know of. If he stole the NV equipment he is just a plain old thief-trash. But, the markings do not make him a thief. I am surprised a bunch of guys on this board have not given him advice on how to keep from getting caught, or if caught how to "get out of it". In the last week, we had a large number posting about how to become a "cable thief" and get away with it, or keep from getting in trouble anyway. A thief is a thief.

Re: Is it legal to own optics that Say U.S. Propery?

First off anyone in the gov trying to sell gov equipement - RUN away from that.

Second, if he was a pawn shop or something that was not questionable due to his relation with the gov then you'd want to look at the demil code to see if it's legal.

In this case it's not known:

NSN: 5855014225413
Item Name: GOGGLES,NIGHTVISIO
Query Type: PUBLIC
Date of query: 10/13/2011 9:10:28 AM

Demail code: F
USML ITEMS - DEMIL REQUIRED. ITEM/TECHNICAL MANAGERS OR EQUIPMENT/PRODUCT SPECIALISTS WILL FURNISH SPECIAL DEMIL INSTRUCTIONS. (NOTE 3).

Re: Is it legal to own optics that Say U.S. Propery?

I like the answer about the Demil code, and want to know more.

<div class="ubbcode-block"><div class="ubbcode-header">Originally Posted By: Mike V</div><div class="ubbcode-body">... a pvs-14 mono scope,... says U.S. Government Property on it ... In other words: Is it a crime for a civilian to be in possession of one?

It was a 'Yes or No' question.

Is there anyone who can give the source for an answer that says "Yes, under these circumstances.." or a reference to rules or regulations that say "No, because..." ?

Re: Is it legal to own optics that Say U.S. Propery?

Ever heard of DMRO???? Being a military guy I know they have autions on base about once a month/ one a quarter selling tons of military stuff. One of my buddies bought a pallet with ammo cans on it with other junk on it too, and inside the ammo cans there were a bunch of new Vectronix rangefinders in the ammo cans.....LMFAO

That was the point of my demil code post.

F demil code very well could end up in an auction and WITH A RECEIPT would be perfectly legal to own.

But, man, buying military equipment from a military guy?

LOL I'd pass on it just to keep my arse out of jail!

Re: Is it legal to own optics that Say U.S. Propery?

I don't know what the big problem is,,, it happens all the time. To be sure, and rest yourself at ease, just make the exchange at your local police station, that way the desk sergeant can witness the exchange and back you up. Especially if there's any future issue.

Sorta like a 'notary public' only better. No big deal.

Re: Is it legal to own optics that Say U.S. Propery?

BTW, Houston Armory has PVS-14s, Milspec that have undergone the certification process for sale $400.00-$500.00, there are others. These things have been around for a while. Rebuild shops etc. for NV are around, in fact, some of the original Govt contractors will rebuild (refurbish)NV equipment for the end user. Again, if it is stolen, the piece of sh98t should go to prison, but being marked U.S. property does not make it U.S. property. How many rifles and pistols marked U.S. have been sold? I will guess millions, M1's-M1carbines, 1911, 03's, 03A3's, Enfields, and the list goes on and on.
