So, in the Smash or Pass thread it came up that maybe if we had a different makeup of jurors, we would get better case law. I thought I would pass on my one day attempt at jury nullification.

I was living in an unnamed city for work, and was called to jury duty. I was selected and the trial began. The basic facts of the trial:

Black man and white woman had met, fallen in love and married. They had a child, then got divorced. She was a hair salon owner, he had what I would consider a normal job. Can't remember. Anyway, is is common in left leaning places, one of the first things a woman does for leverage is to take out a restraining order. This one included telephone and email. There was no suggestion of anything like physical abuse that might have justified something like this. They retained joint custody.

So, one day the father is watching some amateur porn, and he opened up a video, and saw his ex wife getting plowed in the ass. It was her. We watched the clip in court. He was very distressed, and emailed her to say he was concerned about that kind of behavior given that their daughter lived with her most of the time. She proceeded to forward the email and the restraining order to the local police station, at which time he was picked up and tossed in jail. He didn't have money for bail, having spent it on alimony and child support, and spent the entire pre trial time there. He lost his job.

None of these facts were really contested. She put up a little fight that it wasn't her in the clip, but she was very distinctive, had a French accent etc, and there was no doubt. We went to deliberations. I figured everybody would vote to acquit because he was so obviously in the right, but I was the only vote in that direction. I held out for a day until I said something stupid that gave away the plot, and I was accused of breaking my oath and told the rest would vote to remove me. I don't even know if they could do that, but I gave in.

Anyway, juries suck and, as @2aBaCa they should have more power, but I think they simply do not use it for good. It's not easy to hold out, and you have to be more strategic than I was.

Well, tip if it ever happens, if you are trying to hold out, don't say something stupid like "I don't care that he was guilty, he was right." That is, I guess, a way to get dismissed. And I say this as somebody who is constantly telling people not to say stupid shit, even if they are right.

I dont think people see jury duty as a way for the people to shape laws.

Could one argue that the jury was not made up of his peers?

Lets say this new law in Texas about suppressors goes into effect.

Some dude gets arrested by Feds and goes to court.

A jury could find him innocent and strengthen the law.
Or
a Jury could find him guilty and weaken the law.
Either way jurrors are legally obsolved form their decision. They can litterally say NFA federal law is BS and we find him innocent.

The strength of the law sets precedent for other states. Those 12 people.

It all depends on what kind of people are on that jury.

Those are good points, and I am all for them. Just make sure to be strategic in doing it, because most people seem to really want to see people hang for just about everything. It is like you get them in a room, give them power and their fangs come out.

True, but it is also a good story of a conflict between what was an obvious verdict on the facts and law, and what was obviously right. You don't get those that often.

more often than not they are lower class with limited education

most of the "educated" have jobs that they are unwilling to take time from especially if the case could go on for weeks or months

...my friend is/was a DA, his forte is picking jury members

This was slightly different. The jurors were definitely higher "social status" than the participants in this case. I've actually been on three juries, God save me, and that has been the case each time. Of course, these were in a very wealthy city, and the defendants in the other two were gang bangers and a homeless guy.

But, I think you are generally right. And whatever the case, they always seem bloodthirsty.

Yes, and it was discussed in trial. She had certain preferences, certain moves. They showed up on video.

I'm sure he was pissed, but I don't think that had much to do with it.

It's the guy's fault. He should have plowed his gf/wife in the ass, and only the ass, from day 1. It's his fault for generating a child, how the mother raises the kid is immaterial, he should have known better.
 
I think the "gentleman" in the story made one mistake. He should have sent the "smoking gun" video to his atty to forward to her atty. In that way, he would not have violated the restraining order and still got the evidence to where it needed to be. But, so much for that, now. And I concur that the other mistake was the outburst. You can hold out and get to a hung jury/deadlock with only one juror. As long as you don't do something "against the rules" they can't kick you off the jury. Just hold out and let them go to a hung jury and then a mistrial if need be.
 
I know that it is not proper behavior for a juror, but you should have said something in open court.

Then when the Judge says “OMG, Not This Fuckstain Again “, there would be grounds for a mistrial.

Just remember that next time you go to arrest someone for something stupid you know they don’t deserve to be arrested for.

What was the penalty to being thrown off the jury?
I wore daisy dukes to court so my balls would hang out in the jury box, I didn't have to ask to be dismissed the other juror ask the judge to dismiss me, no penalty except the dirty looks everyone gave me.

I've actually been wondering about how all the new intersectionality shit would have changed the verdict. Back then, this was probably '08, women were seen as greater victims than black men, but now that has switched completely.
