Ok so Im a machinist and was thinking about designing and making my own can. What do I need to do to make sure I stay legal? Is it a lot more of a headache (paperwork wise and wait time) than buying a can from my local class 3 dealer?

sorry if this has already been posted. I tried a few different searches and didn't come up with anything.

MC,

Simply put, you need to complete an ATF Form 1 meaning that you are "manufacturing" the silencer. Along with this form you need FBI fingerprint cards, your local law enforcement chief signature and a citizenship paper. Then you send it all in with a $200 check or money order and wait for about six months.

The forms can be found online but some have change in the last couple of years so make sure you have the latest ones. Or you can call the ATF and they will send you a package with all needed forms.

Only after you have received the approved forms back with tax stamp can you start cutting metal.

You can plan all you want before that, but do not start building. Once the outer tube is completed it must be engraved per ATF regs.

There is another way to do all this with a Trust or LLC but I have no experience with this.

I have done one and have another in the works. It's only a little cheaper than buying one but it was a fun project and sometimes I just like to do things to just to say I did.

Check out silencertalk.com There is LOADS of this kind of info on there.

Hope this helps,
CM

Re: Legal questions... Making a can

sure does help. Thanks for the reply. I figure I got the access to cnc machines, material, and I think it would be cool to say "hey I made this" just for the sake of doing it. I've been thinking about buying a can for about a year now, and am thinking about going the route of making one just for kicks.
Thank you for giving me a slightly better idea of whats involved.

Re: Legal questions... Making a can

personally,i wouldnt recomend doing so because the ATF are very likely to show up at your place pretty regular if they find out you have the machines and knowledge to build "cans".Im not saying that you do or would do anything illegal but they will look around until they could get you for something.Just my thoughts..

There have been a number of people here and elsewhere who have built Form 1 cans recently, and I haven't heard of any harassment yet. There are dozens of machine shops in every city and small town who have the machines and knowledge to build items like cans, there isn't any 'trick' to them. Plans are on the internet, too. Which case are you referring to?

Re: Legal questions... Making a can

I have six complete form 1 suppressors , two pending and one ready just working on the parts now. I have never been bothered by anybody about them ,I've even had FBI and loack LE guys come talk to me about what kind of cans I was using and never raised an eyebrow when I mentioned that I built them on form 1's

If you have access to the equiptment and the material then its $200 very well spent , you can taylor the suppressor to meet your needs also like running a tighter bore on a 6mm rather than being stuck with a 308 can.

If you can run your parts on NC then you have the potential to make as good or better than most suppressors on the market in a pretty short time fram
