The FDA regulates IR lasers like the PEQ-15, they are restricted to LE or military users based on public health issues. These units are not eyesafe, you have no blink reflex to IR light. It's not illegal to own, but it cannot be sold to non LE/Mil end users.
So how are they being sold on eBay or are the sellers just unaware of the regulations, when you say to LE/MIL does that mean the department or individual officers and soldiers?
I know personally that some of the stuff sold on Ebay has been stolen by a soldier. I was an armorer and was talking to an armorer from another unit that had a pair of PVS-7B's that had gone missing during a field exercise. Well some idiot was caught selling them on Ebay. He even had a picture showing the serial number of them. The picture had 4 of the 5 numbers of the missing 7Bs. So it is quite possibly that they are stolen or have been listed as a combat loss.
I can tell you the PEQ-15s you see on ebay, gunbroker, arf, or where ever are 99% likely stolen. If you have seen what they sell for (~$3000) you can understand why people steel them. It really infuriates me. I just shat on some supply theifs post a few weeks ago on ARF for listing a stolen PEQ-15. I don't know if he still sold it or not.
There actually was a small batch of these sold to a distributor a couple years ago. The OEM got in hot water over it with the FDA, that regulates these IR lasers. If you end up with one, don't count on getting service from the OEM either... even if it isn't hot from Uncle Sugar's toy box.

Yeah... this. Keep in mind, these are still current issue and are still replacing the previous generations. These guys are accounted for EVERY morning in our armory, just like the weapons.
I was told (from several people) that they could be bought 2nd hand from LE agencies...whether true or not, I don't know. I was also told that you could forget factory service - so make sure it is in working order.
I was in the market for one last year when I was thinking of getting a pvs-14, but decided to buy a dedicated NV scope.
I bought several from local LE guys.
Most are NOT stolen in my opinion.
All the ones I have bought or looked at, I've been able to track down the original owner. 99% it was a LE trade. I traded a LE a upper for mine PAQ4C.
I might sell it on EBay. Not stolen.

No, the import is restricted and if caught at Customs, it will be confiscated.
I'd take a serious look at the new DBAL-D2, which has a good IR pointer and an even better IR illum than the actual PEQ-15. It's for the civ market and should be available in a month or two.
I'm looking forward to the new DBAL mostly for the illumination. I have never been a fan of lasers but I guess an IR laser on the gun will make it easier to shoot coyotes when you have a PVS14 stuck to your face.
I dont see why the guberment has to water down lasers for us mortals. If your stupid enough to stare into an IR laser then you are to stupid for eye sight. I know it could be used criminally but you can get a 30mw IR laser on the internet for a couple hundred bucks. Maybe I will buy the civi DBAL and put a new laser in it.
