    An 84 year old school crossing guard was sitting at a local diner with his friend when he remarked that the school's resource officer often leaves his post for long periods of time and that such irresponsible behavior will make the school's students vulnerable to a potential mass shooter. A waitress at the diner called police upon hearing the words "mass shooting". Responding officers escorted the Korean War veteran back to his house, seized all of his firearms and revoked his State of Massachusetts CCW, which he had held since 1958 as well as revoking his job and title as a crossing guard.

    Police in Martha’s Vineyard used red flag laws to seize the guns of an 84-year-old Korean War veteran over a comment the man made to a friend at a local diner.

    Stephen Nichols was meeting with Edgartown resident Andy Marcus at Linda Jean’s diner in Oak Bluffs a couple of weeks ago when he mentioned that
    Tisbury School resource officer Scott Ogden often leaves his post as kids arrive to drink coffee at Xtra Mart, according to the Martha's Vineyard Times.

    Nichols, who works as the school’s crossing guard, told his friend someone could “shoot up the school” in Ogden’s absence and criticized the officer for “leaving his post.” Those comments apparently unnerved a waitress at Linda Jean’s, who contacted the police
    to tattle on the elderly U.S. Army veteran.

    The server’s complaint was apparently enough to convince Tisbury Police Chief Mark Saloio to remove Nichols from his crossing guard duties, revoke his license to carry a firearm, and seize all of his guns at his home. Nichols was not armed at the diner or during his duties at the school.

    Saloio and another officer physically removed the old man and took him to his house to seize his guns.


    “He came up and told me what I said was a felony but we wasn’t going to charge me,” Nichols said.

    The guns were turned over to Nichols’ son-in-law and Saloio also forced him to turn over his firearms permit on the spot, though the 84-year-old said he was given no receipts or paperwork to document the seizure.

    “He just told me to hand it over so I took it out of my wallet and handed it to him,” Nichols said, adding that he’s never had a violation since he was licensed to carry a firearm in 1958.

    “I’ve got no records of any violations,” he said.

    Marcus told the Times he’s talked with Nichols at the counter at Linda Jean’s for years and the “absurd” situation was created by a waitress who misunderstood his friend’s comments.
    Nichols didn’t like the fact that Ogden left the school unattended when students needed him most, Marcus said, and nobody who knows Nichols would believe he’s a threat to kids.

    Nichols was a longtime special police officer, court officer and constable with an impeccable record.

    “He loves kids,” Marcus said. “It’s almost like of all the people …”

    Nichols said he doesn’t carry any firearms out of the house. The grandfather to 11 and great-grandfather to 11 more said he “would never, ever, ever harm a child.”


    “When I was in the United States Army, and it wasn’t just me, it’s anybody who’s in the United States service, if you are on guard duty for eight hours, you didn’t leave that position,” Nichols said. “And I’m just so accustomed to that, that when I see someone who’s supposed to be protecting kids … leave the school unguarded – if you’re on guard duty, you stay there.”

    Nichols told the Times is wife died two years ago so he took up the crossing guard work to maintain a connection to the community.

    “I just need something to do to get out of the house and I love the kids,” he said.

    Linda Jean’s owner Marc Hanover said he’s convinced “there was never a threat made” and described the ordeal as “absolutely outrageous.” A server “overreacted,” Hanover said.
    Regardless, Nichols is now selling his guns and filing an appeal to get his job back.

    “I would expect reasonable minds to prevail, and (Nichols) to be reinstated to his job,” Dan Larkosh, Nichols’ attorney, told the Times.
    Police Chief Saloio refuses to discuss the debacle, as does town administrator Jay Grande.

    “There’s nothing I can legally discuss about the matter. Period,” Saloio told the Times.

    It does not matter who you are or what honorable deeds you have done for your community. Anybody and everybody is fair game.

    Fear, mistrust, and paranoia. Neighbor against neighbor. Family member against family member. These have been the classic hallmarks of almost all of the murderous totalitarian regimes to grace world history in the past century, no matter what political guises that they had flown.
     
    Let's hope he has some guts and fight in him to take this to court for the long haul & sue the living daylights out of everybody involved including that evil vile bitch of a waitress and her employer & the evil police sons of devils.

    He has a perfect case for going all the way to the supreme court on them violating his first amendment rights as well as a list of others.

    Hopefully he can get some funding support for the legal campaign because this is a great case to hit back at the evil that is these "red flag" laws.
     
    The worst part is many focus on the infringement this places on the 2nd amendment, but fail to see how it obliterates the 1st, 4th, 5th, 6th, and 8th. Once it goes federal 9 and 10 are gone also. I wrote a piece on red flag laws for my page an it is by far the most popular post so this is definitely going to end up being at least one strike of the match.
     
    Well if he's a Korean war vet good chance he's been subjected to worse than this. Probably not in his own fucking country, though. At least not in the last twenty years.

    Essentially, what you are really asking for is for people to be smarter, have thicker skin, and have some common sense. I see all three of those diminishing daily.
     
    "If you see something, say something", has been the mantra of communists and fascists since the early 20th century. They encourage kids to rat out parents, people to rat out neighbors and in the case of "red flag" laws, it encourages socialist justice warriors to report anyone with an NRA sticker on their car to their local socialist cops.
     
    Shoulda stood his ground and refused to comply, he had justification to at least imo. Maybe he did and they just basically laughed at him because they knew he wasn't up to a fuckin thing except being a logically concerned adult. People just doin their jobs which are each compartmentalized within their own usefulness to the state don't seem to give a fuck. Just doing my job. Shit went sideways from the word go because of this see something say something red flag tyranny, realistically it coulda been sorted out the right way though.

    This is the type of next level looney tunes fuckery that makes people change their vote, so I think folks will come around to this red flag shit being bad for everyone involved and hopefully knock it the fuck off. The powers of the state and republic over the BOR need to be curtailed if not abolished completely.

    I’d agree that it seems ridiculous... but there are alot snowflakes out there... and alot of people that are afraid of guns because they are ignorant.

    Hell, I just had a conversation with a friend of my that said “I dont understand how we are so apart on the gun debate.” This is a guy that usually researches everything. What’s been happening is that he doesn’t like Donald Trump, so he’s been reading everything he can find that’s anti-Donald Trump. And that’s a sprinkled With tons of anti-gun rhetoric, which he has been believing.

    Cole is not charged with a crime but is named in an Extreme Risk Protection Order (ERPO) filed earlier this month in King County court. In the civil paperwork, prosecutors and the FBI convinced a judge that “Kaleb Cole poses a serious threat to public safety by having access and possession to firearms and a concealed pistol license.”

    The judge issued an order requiring Cole to surrender all firearms to the police.


    I am even more confused now, how are you NOT charged with any crime, but named in an ERPO, and then all your guns taken?
    This was ordered by a judge BTW - I am going to assume a liberal judge maybe?

    I thought to be named in an EPRO you had to have committed a crime?? Anyone here know how this happens? No crime, but named in ERPO?

    Red flag laws existing violates the 1st, 2nd, and 4th amendments of the Constitution at the same time, how the hell this didnt get smacked down by the courts is frightening.

    I was talking to Stevie Wonder and Blind George down the street and we all agreed that we could SEE this is some bad BS. Thank God most of the Sheriffs in Colorado have all said they would NOT enforce that law.

    I see much room for abuse of this law such as, but not limited too:
    1 A divorce pisses someone off-- Get his guns before he shoots
    2 A neighbor who doesn't like you reports that you take a "gun" to the range most mornings and,"He is Crazy, He likes guns."
    3 "That guy is Whacko, 'Why would you need that many guns' and the list could go on." Any number of reasons.

    Some people will go along with it but some won't. It will not go good in but a few situations.

    Our LEOs deserve a better battle to fight than to go up against an Old Veteran who swore ,"To defend the Constitution of the United States of America against ALL enemies, Foreign and DOMESTIC" and took that Oath to heart and has lived with it everyday from the time he said it til this day.

    At least 2 body bags will be required, One for the Old Vet, and one for the first person through the door, and maybe more that learn that a Garand ain't nothing to be Fucked with.

    For our LE Officers, I think there is as as they would be going against someone who is OLD and has Zero Fucks to give and may have shot many before believing what his Govt. told him but still living by that Oath.

    I truly believe that the LEOs amongst us do read and understand every word that’s posted by all of us. They do not agree 100% with red flag laws, but think they will somehow be able to tell who the honest threats are vs the revenge targets that are bound to be reported.

    I contend that it will be impossible to tell the difference, and that many good and lawful citizens and LEOs will pay the ultimate price for this terrible knee-jerk reaction- that’s brought about by agenda-driven media and stupid politicians.
     
    How federal or state red flag works:

    The mandate comes down to the local PD to enforce.
    Vets, and disabled vets are the biggest targets as these laws become weaponized by SJW's and other thin skinned typed
    They won't hit you while you are at home. Knowing this, targets now pack as much as they can, and anyone in a badge or 5.11's becomes a potential target if they approach.
    Once you are apprehended outside the home, they simply break in, steal all your arms and blades, and you get to fight in court.

    Due process, 2nd, 4th 5th, 10th and 14th Sec 1 all have been broken
     
    This is Trump's fault. Should be clear to anyone at this point. The highest office in the land is telling representatives and delegates to trample on the highest law in the land with red flag raids against citizens.

    This is gonna keep going on because we have "progressive" bastions in every college across the nation. What law school/course is going to turn students on to the idea that they have the power and basis to sue the federal government for tyranny and win? None of them, because it'd be smeared all over the news and Prof. Don't Tread on Me would get the boot for being a rabble-rouser. Realistically, if such a thing ever did get off the ground at all, the federal gov would just form a committee and then that committee would essentially tell you to get fucked. They'd probably pretend to entertain the actual law while the notion of freedom quietly dies off again, but you will go get fucked in the end. They are the government, they are the majority, you are intrinsically outvoted.
