If the guy actually touched him, he should have had his head split in half. It seems obvious enough to me that if the police establish a line, you should stay back far enough away to eliminate any misunderstanding.
It wouldn't be the first of thousands of attempts of some reporter jackass creating a situation and then immediately framing themselves as a victim in an attempt to get more clicks. He could have done his job the same way 50' from the police line.
