    So a person who is in this country illegally cannot be prosecuted for a crime (particularly a gun crime) unless he or she knew that it was illegal.

    The prosecution will have to prove that the defendant knew that what they did was illegal before they can be prosecuted.

    So that throws the "ignorance-of-the-law-is-no-excuse" argument out the window.

    I saw that. While Im glad they ruled for the gun owner, it does seem a bit off.

    The problem was that the gun owner is here in this country illegally. It would have been different if the person was legally here on a visa and purchased a gun.

    The person in this case knew he was here illegally to begin with. That is the entire problem with this case.

    It would be nice if they show the same grace to a legal citizen who has, unknowingly, ran afoul of one of the 20,000-plus anti-gun laws that are already on the books.

    Is this precedent than of acknowledgement that the right to self defense is a "Universal"/"God Given" right for every individual human being regardless of citizenship?

Over the past 25 years, numerous out of state tourists who did not know that their CCW is now highly illegal in NYC limits are tossed in jail and then let go on "misdemeanors" only after the legal fees and court battles have financially bled them dry. The entire gun control system of NYC and NY State, to a larger extent, is a vast and Borg-like bureaucracy whose only interest is financial gain through trap-consume-release.

    but he has basic rights under our bill of rights once he is here, legally or not, fling him back over the border.

    That is a very interesting way to throw things back in the face of liberals.

    The Communists/Democrats/Liberals have been harping that all the rights and all the benefits of citizens should apply to people here illegally.... they just hate it however when you remind them that the 2A is also a right HA!

    Maybe if suddenly illegals can go buy all the guns they want.... The democrats might just get that wall built in record time..... Can't have all their new slaves getting themselves armed.... they might think for themselves and vote from the rooftops instead of as they are told....

    So let me get this straight... someone going to a foreign country (legally or otherwise) has no responsibility to know the applicable laws in that country? Especially in relation to firearms?

    And specific to this instance, someone from Mexico, which has extremely restrictive laws regarding possession of firearms to begin with, has no responsibility to consider laws in a country in which he has entered illegally?

    I don’t follow the logic and am surprised that the Court wasn’t split down the ideal lines. Then again, not much in this Countey really surprises me much these days... we are living in Bizarreoworld.

    Here in Oregon ( i have watched personally ) Illegal immigrants buy firearm that could not speak English language . All that is needed was proof of 6 months residency and he had a person with him to translate where to sign the paperwork ..

    When in Norway was talking to locals, and ( if i understood it correctly ) Norwegian citizens are even legally held accountable and be prosecuted in Norway for breaking ( there countries laws ) while in another country . even if the action committed is Not illegal there in that country they were in .

    The SCOTUS struck down increased penalties for using a firearm in the commission of a violent crime. On the other hand, if you make a muffler that goes on the end of a bang-stick, without registering it or paying the tax, and they will throw the book at you.

    Im agaisnt enhanced sentencing.

    If similar assault happens to me it should be just as big a crime as if it happened to some protected portion of society.
