Having been in enough street fights like this, my first response would have been a swift kick to the head. Done it before and guarantee you that it puts the creep down for a long time.

That is a risk anyone would take. However, given the disparity in size, severity in the attack and that the victim is incapacitated with serious injuries and suffering from further injury I would wager that a jury would acquit.
It's true that may not happen but we all take that chance if we ever have to draw our EDC in public.
