Searched ar pistol w/out much joy.

Does a sub 16" barrel require NFA filing if it is intended for an ar pistol platform?

Matt

Edit: may need to have this moved to the 2nd amendment section, my bad

Re: AR pistol clarification

The barrel isn't the legal issue. Its the lower. You need to have either:
1) a lower marked pistol only (like the ones from Spikes)
2) a lower that has never been transferred as a "rifle" part

This is the way I understand it when I was looking around a few years ago. You can have a short barrel delivered to your house no problem...people do order regular pistol barrels (like for instance a new 1911 barrel) after all. But back tracking your lower you're wanting to use can be tricky. Thats why Spikes can charge so much for their pistol lower. Its the convenience of knowing its legal.

Again this is the information I found when doing similar research several years ago and may be out of date. Apparently lots of letters float to the ATF and once one agent authorizes one thing the letter is scanned and proliferated around the internet as authorization to do whats said in the letter by all who care to.

Here is one such letter

Page 2 paragraph 2 is about the receiver.

Re: AR pistol clarification

Most stripped lower now dont have a rifle/pistol designation. When you fill out the form they are marked as other then the owner makes them into rifle or pistol. Just bought a couple new frontier lowers and one of them is going to be a pistol. Now as far as the upper is concerned you dont have to have NFA stamp to own a upper shorter than 16". Also check out the ATF's site I believe on the FAQ's you will find what you want to know.
