I frequented this site a few years ago. I know that there are quite a number of LEO's that post here. I have a question about an issue my girlfriend is going thru with her exhusband.

This happened today. Her ex came to get her daughter for the weekend. The daughter is 5. The ex drew a gun on my gf's dad standing at the driver side door of his car. Her daughter was in the passenger seat when this happened. She gets out of the car and says she doesnt want to go. He puts her back in the car and puts the gun up then drives away like a maniac. What I need to know is if what he did (pullin the gun in front of the daughter) is considered child abuse?

I figured here was as good a place as any to ask. I know the folks here give intelligent answers. Can anyone help clarify this?

I'm not LE, but with people corroborating that story, child abuse may be the least of his concerns.

You would need to ask the district attorney handling the case. You did call the police and he was arrested right? You should also contact child services. At best this guy will get supervised visits as this is the starting of a downhill battle that will end badly.

Oh yeah, hes screwed. She just wants to get as much as she can against him so that she can get her daughter away from the pyscho.

She did, he left before they got there and are issuing a warrant. But he wont tell anyone where hes at. Hes not a very bright crayon.

You should push this with the DA. Keep calling. The squeaky wheel get the grease. If he pulls a gun on you in broad daylight no telling what is going to happen next. Time for her to learn how to shoot

I thought it was borderline kidnapping considering she got out and said, "I dont want to go mommy" and he physically put her back in the car. She just wants to know if its considered abuse drawing the gun in front of the daughter. So I told her I would get on SnipersHide and ask. (she gave me a funny look of course)

it seems that this should be handled as a kidnapping as he doesnt have legal custory. just has the weekend.

+1000!!! Make sure she finds out who the prosecuting attorney is on the case and calls once a week!!!

Very sorry to hear the problem my girls Ex is a nut bag too but not as bad a that. I feel for you all and hope it has a good ending. PG

Drawing the gun in that circumstance is assault, no matter what. Other charges could be sustained in a court, certainly. It's up to the police to put it before the DA.

Sounds like at least 6-8 felonies are applicable given the presence of a child, kidnapping, the brandishing of a weapon, possibly coercion, assault of the mother and grandfather, recless endangerment, reckless driving: The addition of a firearm can constitute "aggravation" to an already tense situation.

I'd also consider calling "Action News" as those asshats are always looking for a story they can report where they can put up the huge background illustration of a gun while they report the story.

I doubt it's kidnapping, more along the lines of Custodial Interference.

I'm reading this as he had legal visitation for the weekend, but didn't bring her back. That's not kidnapping.

As to not wanting to go with the father, that's more common then you think. Court ordered visitation doesn't give the child a choice.

You also have branishing, but based on your post, I don't see child abuse if he didn't threaten the daughter.

Branishing is a crime of course, in some locations Custodian Interference is a crime, some its civil.

First step would be to call the police (and as I read it, that was done), then contact your daughter's divorce lawyer and get him to work on the case, (DAs pay more attention to lawyers then victoms)

You might not, based on what we have so far, eliminate the father's visitation, but you can probably get supervised visitation, and set it up for future pick up's and returns at a netural place such as the police station.

Op, thats a shitty deal. It would seem they might be able to throw a kidnapping charge at him too. It might help people if they knew what state you are in.
