    TAMPA (Reuters) - A retired police captain shot and killed one moviegoer who was texting and wounded his wife on Monday in a Florida theater showing the hit new war film "Lone Survivor," authorities said.

    Doug Tobin, a spokesman for the Pasco Sheriff's Office, said the shooter, identified by local media as 71-year-old Curtis Reeves, was waiting for the film to begin with his wife when they got into an argument with another couple in the row of seats directly in front during the previews.

    At some point, Reeves brandished a gun and shot both Chad Oulson, who was texting, and his wife Nichole Oulson, the Sheriff's department told CNN.

    "The male victim is deceased. The female victim was injured with non-life threatening injuries," Tobin said.

    Tobin added that the shooter was detained by a fellow moviegoer before being taken into police custody.

    Reeves retired from the Tampa police 20 years ago, according to the Pasco County Sheriff's Office.

    Reeves asked Chad Oulson, 43, to stop texting several times, and left the theater before returning to his seat, Pasco Sheriff Chris Nocco said. The argument began after Oulson asked Reeves if he had reported him to theater staff for using his phone, he said.

    Oulson was shot in the chest, and Nichole Oulson, 33, was injured in the hand while trying to protect her husband as the shot was fired, he said.

    "Lone Survivor," based on a New York Times best seller, stars Mark Wahlberg and tells the story of four Navy SEALs on an ill-fated covert mission against the Taliban in Afghanistan.

    In a statement, Cobb Theatres said it was "deeply saddened" by the shooting, expressing sympathy for the families of the victims.

    "This was an isolated altercation between two guests that escalated unexpectedly. The safety, security and comfort of our guests and team members are always our top priorities, and we are truly heartbroken by this incident," it added.

    Everyone is talking about how wrong the shooting was, but no one talks about how the victim reacted to being informed on to the theater staff. No I don't think the shooting was justified but at this point no one knows the entire story. There is an old saying( you never fxxx with an old man. Why cause he will kill you). The theaters always ask you not to use your cell phone and this is done before the previews.
     
    I basically stopped going to theaters because people behave like animals. If I really want to see a film on the big screen, I try to time it where it's JUUST about to rotate out of the theater (better chance of the showing being deserted)

    The fact the asshole threw popcorn into the shooters face while quickly moving his strong hand, would tell me something. Retired or not training takes over. A call for the jury only, or those who were there that Seen and Understood what was happening.

    I'm 71, and have had two heart attacks and a stroke; so an "ass whooping" has the has a very real possibility of killing me. So if I think that anyone has an ass whooping in mind for me; I sincerely hope that I don't set that person's clothes on fire with the muzzle blast of my .45!

    After two tours in Vietnam as a Marine; it would pain me to be characterized as a cowardly fuck.

    I just don't get it, coming from a LEO, the retired guy should have known better, really over a freaking cell phone? The few times I go to a movie theater I carry. I carry for many reasons mainly for self preservation and for my wifes. I am a firm a believer that as an off duty cop my 1911 is to get me out of trouble not into it. There are carzies out there and people not happy with me becasue I have put bad people in prison, revenge is a strong and powerfull motivator. Shooting someone over something stupid like cell phone use in a theater, especially when the other person has a spouse with him? Grow up ! Another black mark on a profession that's tough enough already, thanks for making it worse.
     
    Seeing the news this morning the suspect is claiming, "Stand your ground" as that law exists in FL.

    I am liscensed for CCW and I can't say that, given the information that I currently have, that this is a shooting situation. Not having the whole story it's hard to make any determinations. It kind of feels like the suspect is now shielding himself behind the "Stand your ground" law, which has high potential of making it an untenable defense for those who might have a higher need of it in the future. It's just hard to say, since very few people know, and if there were any verbal threats of violence I think those can be used as evidence for a legitimate state of fear by the suspect. Does anyone know?
     
    I usually go mid week to the first showing of the day. Theaters are usually pretty well deserted then, especially if most of the kids are in school (at least the ones who aren't cutting classes/school).
     
    The article I read said, 3yr old daughter?... if that's true, he has one fuckin smart 3yr old. Or, he's lying and that's why he got huffy puffy and shot. We'll see what evidence comes out at the trial.

    I dunno, people can be very annoying especially in a movie theater. Loud popcorn eaters and that omnipresent asshole who finger fucks his candy wrapper for 2 hours deserve some sort of ass beating but obviously not a bullet and certainly not during the previews.

    If you read the entire account the shooter did go tell the theater staff and when he returned he was confronted by the guy texting. And most theaters I go to tell you before the previews to please turn off your cell phone and or stop texting. The real story will come out at the trial.

    Maybe the theater is responsible since the article said he went out to complain to the manager. If the person in charge of enforcing the rules did fulfill his duties then this cinema mayhem would not have happened.

    I agree with Pappy42 about this. In fact, the physical condition of both parties in an interaction is one of the factors to be considered in the use deadly force. Where a man of the same age and physical condition might be more expected to "go fisticuffs" with someone, an older person, or someone who has physical disabilities is generally justified in escalating to a higher level of force in order to offset the disparity in physical size and/or condition.

    In the totality of circumstances, if the level of force is justified, the means for application of that force is not important. The key there is the "totality of circumstances".

    For whatever it is worth, I used to teach use of force, and use of force report writing...

    LEO or not a young guy escalate the situation by getting in the old guys face. And I do agree to a point that deadly force should not have entered into the problem, but no one knows what kind of shape the retired officer was or is in. Still if the vic had not escalated the situation he would still be alive. At this time both parties are at fault, it's just sad that one had to die.

He then returned to the theater, the altercation resumed, the victim threw popcorn at the shooter, and the shooter shot and killed the victim.

    Makes me wonder if the shooter really left the theater to go fetch his handgun. He had a history of altercations with moviegoers at the same theater complex. I could see this becoming first degree/capital murder real fast if they find evidence he left to get his gun.

    That is a interesting thought. A little birdie told me that there are 32 surveillance cameras in that particular theater complex. The equipment is all very high quality and capable of capturing any event in any lighting condition. This type of system is light years ahead of the normal convenience store set up you see on the news. One of their cameras costs much more than many whole 4 camera convenient store systems.

    I do not see where he could have gone to "get a gun" Suppose he went to his car he would have had to buy another ticket to get back in right? This just sounds so preposterous that I think it unlikely. I think he went to complain to management, they were busy with another customer, rather than wait he just returned to his seat.

    Word here is the old man was bitching at the victim for texting during the commercials. The shooter left the auditorium and when he returned he got back into it with the guy who was texting his kid. The guy texting got pissed off he threw a piece of popcorn at the retired cop and the cop shot him.

    (CNN) -- In a dimly lit Florida theater, Curtis Reeves got into an argument with another moviegoer over texting. The two men exchanged words that gradually became more heated and Reeves felt something hit his face.

    Reeves, who minutes earlier had gone to seek a manager's help to stop the texting, this time reached into a pocket in his pants for, police say, a pistol.

    He later told police he feared the man was going to attack him.

    Reeves, a former police officer, pulled a gun and shot once, hitting Chad Oulson in the chest and Oulson's wife, Nicole, in the hand she was using to grab her husband in an attempt to calm things down.

    As the victim struggled to breathe and fell onto two other patrons, Reeves sat down. An off-duty deputy five seats over charged toward him and grabbed the gun, which had jammed.

    Chad Oulson died later at a hospital. His wife's wound was considered non-life threatening.

    The shooter's son -- an off-duty Tampa police officer -- was just arriving at theater 10. He had been delayed to his date with his father and his mother, and he had no idea his dad had just killed another man.

    On Tuesday, Curtis Reeves, 71, made his first appearance in court for a charge of second-degree murder. Reeves' attorney, Richard Escobar, tried to persuade Circuit Judge Lynn Tepper that the former police officer was actually the victim in the incident and that Oulson was the "aggressor."

    Police said despite Reeves' claim that he was in fear of his safety, this was not a case for Florida's "stand your ground" defense.

    "Working with the state attorney's office it was determined that stand-your-ground does not fly here in this case," Pasco County Sheriff Chris Nocco said.

    Authorities said a preliminary investigation had determined that there was no physical contact during the incident Monday afternoon at a theater in the Tampa suburb of Wesley Chapel. It was popcorn, thrown by Oulson, 43, that struck Reeves.

    Sgt. Steve Greiner, the first Pasco County deputy to encounter Reeves, said the suspect was very calm as he sat in his chair. He had an almost distant stare toward the screen, Greiner said.

    Reeves also stared silently into a closed-circuit camera Tuesday, listening to Escobar tell Tepper why his client should be granted bail.

    Tepper said there was no evidence to support the claim that the shooter was a victim, according to a probable cause affidavit. She denied bond and ruled that Reeves should face the second-degree murder charge.

    The judge addressed Reeves and asked him if he understood what had happened and that he was facing life in prison; Reeves said he did. Reeves' attorney then said that he and his client would speak in private, indicating that the former officer should not say anything in court.

    Reeves wore a bullet-resistant vest. Nocco said it was for the defendant's safety.

    The shooting happened Monday afternoon at the Grove 16 theater about 1:25 p.m. ET, just before an afternoon showing of "Lone Survivor," a film about a Navy SEAL mission.

    Reeves was with his wife and sat behind Oulson and his wife, authorities said. Chad Oulson was using his cell phone and Reeves told him to put it away, according to police and witnesses.

    The two men began to argue and Reeves walked out of the auditorium. Police said Reeves was going to complain to a theater employee. But Nocco told CNN on Tuesday night that the manager was busy with another customer and Reeves never addressed his complaint with a supervisor.

    When Reeves returned, witnesses and authorities said that Oulson asked him if he had gone to tell on him for texting. Oulson reportedly said, in effect: I was just sending a message to my young daughter.

    Police said Tuesday that Oulson was texting the daughter's babysitter.

    Charles Cummings and his adult son were two seats away. Cummings said that when Reeves returned to the theater, there was no manager with him.

    "He came back very irritated," Cummings recalled.

    Voices were raised. Oulson threw a bag of popcorn at Reeves, police said. Then, the former police officer took out a .380 semi-automatic handgun and shot Oulson.

    As Oulson staggered and fell, "He said, 'I can't believe I got shot,'" the younger Cummings recounted. "Blood started coming out of his mouth. I was trying to hold him up. He just fell down."

    "I can't believe people would bring a pistol to a movie," said the elder Cummings, a Vietnam War veteran who was celebrating his birthday by spending the afternoon with his son.

    During Reeves' first appearance Tuesday, his attorney argued that Oulson was the "aggressor."

    "It may or may not have been popcorn," Judge Tepper said, but an unknown object "does not equal" taking out a gun.

    Witnesses told police they saw no punches being thrown during the incident, according to the report.

    There were about 25 people in the movie theater. After the shooting, some tried to help Oulson and to make sure no other people were hurt.

    An off-duty deputy sheriff from Sumter County rushed over to make sure no more shots were fired and that the shooter was not going to get up.

    One of two nurses in the audience ran to Oulson's side and performed CPR until paramedics arrived. An autopsy will be conducted Tuesday.

    Reeves retired in 1993 as a captain with the police department in nearby Tampa. He also was director of security at Busch Gardens until 2005, a spokesman told CNN. Police told CNN that Reeves was instrumental in establishing the police department's first tactical response team.

    Records released by the department indicate that he was often praised for his work ethic and leadership. Negative remarks were rare, such as a 1979 evaluation that said he had shown a temper when dealing with supervisors.

    After court Tuesday, reporters circled Escobar as he headed to his car.

    Escobar said that Reeves has "great credentials" and called him a "great man."

    "Certain circumstances happened in that theater," the attorney said, and those details would come out at trial, he said.

    "Mr. Reeves is certainly heartbroken," that someone lost their life, the lawyer said.

    A neighbor told Bay News 9 that Reeves is a nice guy.

    "Always smiling. I've never seen him angry," Bill Costas said. "If I needed help with something, he was always there."

    Chad Oulson was a former U.S. Navy petty officer, serving from 1990 to 1997, according to spokeswoman Lt. Richlyn Neal.

    Tuesday morning, a woman who said she was Oulson's sister answered the door at his home in the Tampa suburb of Land O' Lakes, the Tampa Tribune reported.

    She told a reporter that the family is in shock and declined to comment.

    In the home's garage, the Tribune reporter said, a motocross motorcycle was on a stand next to a gold pickup truck and a child's wagon.

    "He loved his job, loved his family, loved motocross, loved the motorcycle world," friend Joseph Detrapani told the newspaper. "He grew up riding motocross and loved to keep doing it, even at his age of 43, he's still out there every weekend riding."

    Meanwhile, Cobb Theatres, which operates the Grove complex, released a statement: "This was an isolated altercation between two guests that escalated unexpectedly. The safety, security and comfort of our guests and team members are always our top priorities, and we are truly heartbroken by this incident."

    A list of prohibited items and behavior in their theaters is on the theater website. On the list: no cell phone use, including texting, in the theater auditorium. And no weapons allowed.

    The I see it is when he left the auditorium by law the threat was over and when he came back and re-in gauged at that point he becomes the aggressor and is guilty of 2nd degree murder.
    Just my thoughts for what they are worth and as had been said we don't know the whole story.

    #1, In Florida, the old people are more Armed than most state National Guard units, they will kill you if you look at them cross eyed, period.

    #2, They never get convicted, they mostly get community service awards.

    #3 Our old people population is dense with combat vets, they will kill you if you threaten them in any way. Speak clearly and loudly when you talk with them so they don't misconstrue what you are saying and shoot yer ass, smile at them, it helps.

    Some advice for you visitors to the home of happiest place on earth, have your fun, get crazy, do all the stupid stuff you want to do, but a few rules we have here, very simple ones, dont hurt other people, dont get caught with Drugs or commit a crime with a gun. Drugs, cops will put your ass away for a long time here, no mercy, violence against others, Joe or Jane citizen will shoot your ass dead, they might even be a bystander and still legally shoot yer ass dead, for real. Follow this advice and you will have a blast (in a good way) in the state.

    You're right, I agree. They're both assholes. The world is full of them. The victim, instead of throwing popcorn and arguing could have simply said that he was texting his little girl like you said. The shooter had a gun but didn't need to use it. He could have moved away if the phone was bothering him. Being disturbed by an inconsiderate schmo isn't justification to take a life. Just because you have a gun doesn't mean you have to use it.

    This is senseless in every way.
     
    The more of the story that comes out, the more the shooter looks to have been an insane power mad nut case.
    There are other witnesses coming forward saying he threatened them and stalked them in the theater.
    This is the kind of nut job the liberals love as he gives all law abiding CHL holders a bad name.
    I'm pretty sure he will also be a shame to his previous profession, as there will be comparisons made by some who read the story, with not retired people of the same profession he was, having a similar mindset & disregard for others.

    So what if someone is texting something while the endless commercials / previews play. Big deal, some people in this thread make it sound like the trailers are their god and someone is disturbing their worship of their false god. Most theaters leave the lights partially on during the commercials / previews specifically so people can get settled in. If you get that worked up over movie trailers, then you need serious mental help.

    Hopefully they throw the book at him good and proper & the victim's family sues & gets everything he has.

    Would you feel the same way if it was your kid that was killed cause he was texting his/her buddies while waiting for the movie to start?
