In Texas, it is legal to record a phone conversation as long as one party is aware the conversation is being recorded. This includes you as one party on the line. It will hold up in court. VERY easy to do if you call from a land line with a cheap tool from Radio Shack. Harder to do from a cell phone, as I have learned.
As I suggested with others, and other have suggested to you, if you paid with a cc, which you did for at least 500.00. Call them (Visa) now and inform them of the situation. They do have timeframes on these issues, but being that you have not yet completed the transaction might be in your favor.
I would think long and hard about lawyering up due to the money alone. The Hide's/Spartan Precision's battle against this guy is one of principal, ergo, allowing products to be reviewed and criticized on public forums. Your issue, unfortunately, is that you have not received what you have paid for. The cost of an attorney is going to be more than your rifle. you think this guy hasn't seen form letters from attorneys before? Definitely not going to prompt him into doing diddily shit. Assuming you win, collection of said funds is a whole 'nother ballgame. However, small claims court is your friend and is the perfect venue for this kind of stuff. Do any of your order forms contain an ETA? Do any of the order forms have a stated restocking fee should you cancel your order? I did not see it on their website.
What I did see on their website was the number of FB followers...poor people? You know they haven't ordered from them. Probably just thought the name was super sweet because it has "tactical" in it. I also saw they have an "m40" ready to sell right now, under their rifles ready to ship deal...you know, the same one that appears to be identical to the one they are "giving away" under their gun ban raffle. It says it has a Krieger barrel on it, chambered in .308. Maybe he could just give you that rifle instead?

FWIW, if you’re going to travel to Florida you may as while stop by the county court house and file the paper work first so you can serve him at the same time of your visit... I am far from an expert but I know locally it costs less than 50 bucks to get the ball rolling and would need to be filed in the county of the business address. I’d also check into if you can add travel expenses to the claim....
If you paid for this with a credit card call them and dispute the charges...simple. They will just take the money from him, then HE has to fight to get it back. I would immediately contact your credit card company as well as I would see about making out a police report here in Florida for fraud, possibly grand theft. I dont live far from this asshole.

I talked to Bartlein earlier this week about a 26" 30 cal 5R, 9 twist, straight taper, for a 300 Win Mag - 6 months for the barrel, plus 2 more months if I want them to chamber and fit and do the brake. I haven't bought a Krieger in a couple years but they never took more than 6 months.
I appreciate all the advice. I have a plan and will move forward with it. We'll see how it goes.

I don't understand why you sued David Rooney, As far as I saw is he paid to get a Gun made and then had an issue with the company, are you the company who he said he was having issues with ? Or are you IH8DavidRooney ?

That guy is a real piece of shit. He was using that guy jim Gilliland to push his rifles about 10 years ago. Ended up scamming my unknowing friend pretty good. Rifle was a complete turd. Painted with krylon, stripped base screws, shit bottom metal and rings, terrible bedding job, and the rifle didn’t shoot very well for the 5k he charged. I wrote the guy an email on my friend’s behalf and the scumbag just dismissed me with a bullshit response
