The only way to convict all the bad guys was to convict all the good folks too, and the only way to never convict a good guy was to let all the baddies go too.
Somewhere in the middle is the least bad answer we as a people can make.
I prefer that least bad answer to be tilted slightly towards higher burdens of proof of the part of the prosecution, and so generally has been the criminal justice system.
ROE is a facet of this. Statistically you end up with a question of how many innocent people does your ROE chew up and spit out as dog meat. And can you achieve your mission at these levels.
