OK guys, need some guidance/help. An elderly neighbor gave me her husband's WWII 1911 after he passed away. I've kept it in my safe but we never did any transfer paperwork. She has recently passed away and it got me thinking about how it's registered. I'm kicking around the idea of trading or selling it but don't know the legalities of doing so. Anyone out there have any input or can point me in the right direction? TIA

Re: 1911 transfer Q's

There is no federal registration per se, although that is a common misperception. When you fill in the yellow sheet (form 4473) at your dealer he calls it in for a background check. The only info he tells the examiner is the type of weapon. The form stays with the FFL until he goes out of business. Even the NICS information is erased, the only info the Feds are allowed to keep is the NICS ID number and if it was approved/denied/delayed. The ATF can do a skip trace on a specific firearm but that involves following a trail from the manufactuer etc direct to the last dealer.

Legally you can trade sell etc. but I have to say this: That sounds like a very generous and meaningful gift. I say you keep it in the family enjoy cleaning it a few times a year if your not going to shoot it.

FFL only needs to keep the 4473 for 20 years.
