ATF Charges American FRT Trigger Owner For Illegal Possession Of A Machine Gun

Whatever his actual intentions were, and whatever the actual truth of what happened really is, the entire situation played right into the hands of the government and was the excuse for even more power and using the government against anyone who spoke ill of the government.
The narrative was quickly and easily changed to garner sympathy for the government.
 
The Definition.

What exactly is the definition of a machine gun? That is found in 26 U.S.C. § 5845(b):

“The term “machinegun” means any weapon which shoots, is designed to shoot, or can be readily restored to shoot, automatically more than one shot, without manual reloading, by a single function of the trigger. The term shall also include the frame or receiver of any such weapon, any part designed and intended solely and exclusively, or combination of parts designed and intended, for use in converting a weapon into a machinegun, and any combination of parts from which a machinegun can be assembled if such parts are in the possession or under the control of a person.”​
It’s a bit complicated, but at least Congress didn’t need a half-dozen subparts to describe what they meant.

The core of the definition is “any weapon which shoots . . . automatically more than one shot . . . by a single function of the trigger.” Also included in the definition is any combination of parts that cause a firearm to fit into that core definition and the frame and receiver of a firearm that fits within that core definition. The latter is why you can’t simply convert a machinegun into semi-automatic functioning.

More than one shot, without manual reloading, by a single function of the trigger.

From the looks of the charges, he had worse things than a couple of FRTs. Looks like an illegally converted MP5 clone, 38 3d printed glock full auto switches, a couple of unregistered suppressors, and what could be several unregistered SBRs.

WV vs EPA won't protect him from any of those charges, even if it does get the FRTs dropped.

How incredibly convenient! I wouldn't be half surprised if they also found a few keys of cocaine, child porn and his handwritten manifesto detailing his plans to overthrow the government and reestablish segregation in the US.

Then after he hangs himself with a bed sheet in his cell before making it to trial we can forget all about him and focus on more important things, like monkeypox and global warming.

At this point in the timeline of tyranny - it would be foolish to believe or take at face value - ANYTHING the alphabet agencies say.
They all appear to be out of control rogue agencies only interested in persecution and prosecution of anyone not aligning with the leftist agenda.

The more likely explanation is that the guy is an idiot who got caught doing shit he knew would potentially put him in conflict with the feds.

As this guy is about to find out, the government and the courts love and I mean LOVE to setup show trials and make examples of them to keep the rest of the sheep in line.
And the guy is probably going to find out that his fellow "strident 2A supporters" aren't going to be storming the gates to come rescue him.
It's going to be a long, expensive road and he better have money and good lawyers.

This is why the government finds doing oppression so easy.
No need to go after everyone, just regularly go after a couple and put the boots to them hard to keep the rest of the sheep from doing freedom stuff.

The fed LEO are the criminals. The same can be said about all LEO considering how they all work together to support one another.

I mean... if I owned a company that was duking it out with the ATF I would keep 38 counterfeit glock full auto conversion devices, 27 unregistered SBRs and a bunch of serial number free cans in my house too.

I'd be inclined to believe this if the raid came out of the blue. Months into a federal case with the ATF, you can consider me skeptical.

There's no doubt that the Feds will go for the low-hanging fruit.
But they've been shown to make up their own facts and create and facilitate crimes to garner the attention they want or push their agenda.

Whats a few Glock selectors, finished/unserialed 80% lowers bolted onto SBR uppers, and finished solvent traps among friends?

There is of course the very real possibility the ATF straight up lied and / or also straight up planted evidence.

That being said as a disclaimer, it does seem to follow a pattern that some of the folks who the headlines say got busted for something in the "grey area" or "still under discussion as to the status", tend to have a bunch of other stuff going on as well where they clearly stepped over the line with the government.

Much like the headline arrest for the guy selling the metal calling cards that had the outline of a lightning link laser engraved onto them. It seems the more in depth story was that he had a lot of other "stuff" going on as well.

There might be something to be said for if you come up a few too many times on the radar for "naughty stuff", the government decides you are a good candidate to make an example out of, since they are sure to get a conviction or plea agreement on at least one or more of the stack of things.

I said nothing in support of the NFA, ATF, or any of the DOJ's unconstitutional BS. Nor will I.

It's easy to call folks cowards from behind a keyboard. Or rant about how the NFA is unconstitutional and how ATF should either cease to exist or focus on things that actually matter. But we as a community have a history of bitching and moaning online, calling each other cowards, and doing nothing that actually helps someone who's run afoul of the Fed.

My point was that anyone who knowingly possess that quantity of unregistered NFA items (or any, really) without understanding and accepting they may be placing themselves in conflict with the Leviathan that is the DOJ, is an idiot. Or I suppose maybe just a self destructive masochist.

Doesn't mean I like it, support it, or wish it to remain unchanged. Maybe he understood the potential consequences of having 40+ unregistered NFA items in his possession and decided he was willing to take his chances. Maybe not. Maybe as some of you are suggesting he's a sweet little innocent baby who got framed by an ATF agent, but I find that unlikely.

Either way I'm guessing no one in this thread is going to do anything to help him out.

Hell, I'll bet some of you can't even be bothered to donate to organizations like FPC who are actually doing something.

After the most recent federal imposed regulation on my 2nd amendment rights, I emailed my "Republican" senator to express my displeasure.

She responded that it should not be a problem unless I was a criminal (or words to that effect).

The problem is that the new regulations start me down the path on the way to becoming a criminal. A path that I was not on before.

Since gang bangers can't shoot, innocents get caught in the crossfire. Decent LEOs (like my daughter) have to respond to shootings where innocents in the wrong place, get capped between the eyes over some gang dispute.

To be fair, those folks pretty much were in the "After the first one all the rest are free" situation.
