Miserable CA
This is the gentleman charged in AZ with murder after reporting a dead body on his property last year. The body belonged to a Mexican national who was trespassing across Kelly’s property along with a group of individuals. Kelly called the cops after he heard a shot. He also fired warning shots over the group’s heads from 115 yards away. A bunch of leos responded and combed his property but did not find the anything. Kelly‘s dogs found the body with a bullet hole in it later that evening. Kelly called the cops again. They gladly responded to arrest him. Anywho, Kelly’ trial started yesterday. His lawyer seems on top of things.

I watched the opening statements. Seems like he is being railroaded. There are a lot of lessons to be learned here:

Lesson one: bodies buried in the desert are real hard to find. Especially an illegal that no one is gonna report missing.
Lesson two: LEO are not your friends

In this case the family of the deceased reported it. They even provided a false witness who beclowned himself during the course of the investigation. Still, they elected to prosecute.

This right here.
I have friends that have been LEO. But Prof. James Duane said do not talk to the police. It doesn't matter if the cop is someone you went to school with. In an investigation or police action, they are not your friend and by definition, they cannot be. The job of a police officer, unironically, is adversarial against the public. They are enforcing laws and will act against you. That is the job, not some over-arching evil plan.

So, yeah, It would have been better to bury the illegal without casket so that the worms and bacteria take care of it. And then not say anything.

Here is Prof. Duane to explain it in detail better than I can here.

Right now Mr. Kelly has a fairly good chance of being found not guilty. If he had buried the body his lawyer would be working out a deal.

Well, does the bullet in the body match his? Firing in the air is dumb as fuck. Bullets gotta land somewhere. Blanks might be a better idea, however there could be legal ramifictions to that as well, also, what if the dark shoots back....

Apparently the bullet was not recovered.

If he did not shoot the illegal and merely buried it, that would be "abuse of a corpse." If he said he knows nothing if someone did investigate (not likely,) that would have been hindering prosecution. Either one of those carries less weight than murder.

So you’re saying that committing a crime in order to hide a crime you did not commit is better than just calling the cops to report a dead body?

Just stop. You are being ridiculous and are far from a “gotcha” moment. Some of the most vile people on earth are the politicians who decide what is and what isn’t lawful. Another group and arguably worse type are those that enforce the laws set forth for a paycheck and a pension. If you can’t see how laws are nothing more than tools used by criminals/gov’t to control and manipulate decent people than you aren’t very bright. The man should have shoveled and shut up instead of phoning a criminal enterprise.

Because nobody was watching, right? Not the cops. Not the cartel. He was free to do all that, right? Maybe you should watch the second video, the one of the defense opening statements. It talks about big picture considerations.

In hind sight for this guy, yes. He did that exactly. Reported a dead body. They arrest him, knowing they will never find the cholos that did this.

I read somewhere that the trespassing illegals were armed at the time of the incident.

No bullet recovered = zero proof that his gun shot this man. Equital peroid. What other proof would the prosecution provide? The prosecutor in this case should be disbarred and arrested for illegal prosecution.
The end.

And the prosecutor personally and the jurisdiction therein sued. As well as the police department and the particular arresting officer.

Everybody, and I do mean everybody gets some consequences. QI might stop criminal charges but lawsuits can still be brought. I know because it was part of my classroom training for a state commission in the early 80s to carry a firearm on duty and in uniform.

Any unbiased, American-minded Prosecutor would have said "that bullet could've come from anywhere" and simply not pursued the charges against this American patriot and legitimate hero named Mr. George Kelly.

In private a good prosecutor would've said to his closest allies "the only good illegal is a dead illegal".
