Badger ring ? think i found a problem, help

Hi
just got a set of 30mm M40A3 rings they are brand new i noticed that the smaller 4 screw ring sits on the base at a slight angle. Upon closer inspection i noticed that it lookes like the cross bolt that secures the ring to the base apears to be canted. has any body had this happen?

Is there any way to fix this? Or should they get returned for another pair.

Update. I thought i would try this first. I placed the ring in the base. And slowly tightend the nut. I noticed that it began to line up i kept going slowly until 65inch pound was achieved via the torque wrench then took the ring off and checked it. ALL is goodnow it straitend it self out and it sits flush upon reinstall.
