Right, but a hate crime over property seems a bit of a stretch.
Oh I agree with you on that 100%, in general I am opposed to "hate crime laws". It is either against the law to harm someone or it is not.

We have laws that "include" everyone. Such as, a lender can not deny a loan based on sex, religion, race.....blah blah blah. And then make laws that single out all of these people individually. (except white Christians of course).

I am okay with the "include" laws but the "single out" laws not so much.
 
Well it wasnt his property to tear down and burn. So there’s theft, and destruction of private property. Now if he bought and burned it, have at it. His property.
 
The Hate Crime was not because he burned private property. The Hate Crime was that is was a threat against LGBTQ people....like stealing and burning a cross or stealing and burning a flag with a Jewish symbol on it.

LGBTQ folks are a protected group.

First, one should not take anything that isn't theirs and certainly not purposely and willfully destroy another's property.
Now, if burning an LGBTQ or Jewish or and other ethnic flag is a hate crime then so is burning an American Flag. After all, regardless of what certain groups want you to believe, the American Flag is the most powerful of ALL ethnic flags. ALL Americans stand equal under it.

I think this is more common than you think. I worked with a fellow whose brother was gay and the brother was a member of an "all inclusive" church and that included gay and lesbian folks.

but the “hate crime” statute in Iowa, which sort of functions as a sentencing enhancement for certain offenses states, in part, as follows:

“Hate crimes are defined as crimes committed against a person of their property”

The interesting part to me is I’m not sure whether a “hate crime” can be committed against a “non-person” such as a corporate entity or a charitable entity which are sort of “legal fictions” created by the state. Would be an interesting appellate issue imo but I’m not familiar with Iowa law or the history of hate crimes to know If this sort of thing has been challenged before but will look it up when I have time.

It’s becoming painfully obvious that we need to start a religious organization that worships guns. Any attack on our rights or our religious items would then be considered a hate crime. Tit for Tat. Let the laws help protect our constitutional rights from the bigots that hate us for exercising those rights.
 
If he hates gays he went about it all wrong , what happens now is that he has to Toss Salad and get his Shit Pushed in BIG TIME when entering prison. He should of just joined the church because for the next 15 years he will become a rainbow warrior which he set out to hate originally.

Nah, you have to be the right kind of gay. You see, I myself am a white caucasian cisgender Southern gun-owning military-supporting gay. Being gay means nothing when I have all those other descriptors, especially the white and gun-owning ones. Because, you see, me being white and owning guns, and being a Southerner whose ancestors owned some slaves (and also were on the gun crew at Ft Sumter who fired the first shot of the Civil War, according to my genealogy-interetested uncle) means that I am a racist and a colonialist and am not worthy of being gay. Or whatever the current double-standard is, bugger if I know...
 
Yea, you're a real piece of fucking work. People who don't define themselves by their race/gender/orientation unilaterally are the worst.
But if I was a transgender Black Hispanic gun-fearing "yas quean" Californian gay with blue hair, I'd get all the Oppression Points and I'd win the solid-gold Kewpie doll, and they'd probably give me a Senator's office to boot. :p

So if someone grabs your MAGA hat burns it and or does physical harm to you that's not a hate crime because it's political? Don't know who allowed the hate crime shit to happen anyway. It's just another way to limit free speech. If someone does something illegal to someone else they generally hate that individual for whatever reason. Same penalty for the same crime should apply otherwise It's not constitutional in my opinion. Burning a flag is destruction of private property never heard of a 15 year sentence for that (even repeat offenders) more to that story. Apparently across the pond hate speech alone can get you a prison sentence. Just who decides what the definition is? Sounds strangely familiar of communist countries.

And there lies the double standard. Only one instance of a MAGA hat being taken off another person's head was the woman arrested, and I don't know the outcome of that.

Yes it was not his property, and yes he had priors and that was the main factor of sentencing, however, the left has been notorious for destroying property such as hats and nothing happening to them.

The title was not intemded to be misleading, it was shortened so it was to the point.

We are not a nation of hyphens. We were never supposed to be. We were supposed to be We The People. The American People.

I don’t think anyone here has any issue with enforcing property rights or that it should be a crime to destroy someone Else’s property without permission but I think what is upsetting to people is that people destroy and burn American flags that aren’t their own and aren’t charged with hate crime but when it’s a rainbow flag it’s a hate crime and that just doesn’t pass the smell test for a lot of
