    GRAND JUNCTION, CO (KREX/CNN) – A Colorado man, who was convicted in 2015 on charges he sexually assaulted six young boys and girls, is now free after his conviction was thrown out on a technicality.

    After news broke that 46-year-old Michael McFadden was released from prison Tuesday, Kathi Raley, victim assistance coordinator at the district attorney’s office, was on the phone non-stop.

    "Voicemails – several from mothers of victims, who legitimately are fearful for their children and their children's safety,” Raley said.

    Raley says, unfortunately, she hasn’t been able to offer much help to the victims.

    “This is now a case that will just be dismissed and set aside. So, it's an unfortunate situation that they're all in,” she said.

    McFadden appealed his conviction, claiming pre-trial delays violated Colorado’s speedy trial statutes.

    This past June, the Colorado Court of Appeals ruled in McFadden’s favor, throwing out his conviction and ruling he could not be retried.

    District Attorney Dan Rubenstein says the outcome is something he never saw coming.

    "Frankly, I am completely appalled with the decision. I find it offensive that our justice system would allow this to happen,” Rubenstein said.

    Rubenstein says McFadden asked for a continuance of his trial twice – at which point a speedy trial was automatically waived – but on his third continuance, McFadden decided to assert his speedy trial rights.

    According to Rubenstein, there are two types of speedy trials: constitutional or statutory.

    In the state of Colorado, statutory speedy right trials require a time frame of six months, but with a constitutional speedy trial, there is no time frame, depending on the case.

    "There's prior precedent from other cases, where the court has said that constitutional rights outweigh statutory rights,” Rubenstein said.

    Still, the appeals court ruled the statutes had been violated.

    When the district attorney’s office appealed to the Colorado Supreme Court, the high court decided not to hear the case, upholding the lower court’s ruling.

    Because of that decision, McFadden was freed from prison, leaving many families in the community outraged.

    "The justice system completely failed in this situation, and you've heard the phrase before ‘got off on a technicality’? This is that situation to the most stark sense I've ever seen it,” Rubenstein said.

    Rubenstein says McFadden does not even have to register as a sex offender.

    It is unclear where McFadden plans to live following his release.

    I was out that way in the mid 90's and I commented to a local shop owner about how few police cars I'd seen in a week.
    He said the locals kind of took care of things. For example, if word got out that Ed down the road was beating on his wife or sneaking around and looking in people's sheds at night, some of the boys would get together and go have a talk with him about it. On average, Ed would either straighten up or have a bad accident.

    You are missing a couple things in your haste to lash out because the result sucks. One is that while it is easy to blame LEO, it is not their failure. They brought the perp to face the court.

    The second is that it is the people that have failed.

    Who's responsibility is it to ensure that the system works? It is so easy to abdicate our responsibility.
     
    The 23:00 News just said that this asshole showed up in Colorado Springs where the Police nabbed him for not registering as a sex offender so he is back in jail already. Good show CSPD, that didn't take long!!! Tightened up already.

    I thought that I had read that he wasn't even going to have to register. Not that he isn't deserving of justice, but either the press got it wrong, or there's some catch-up goin' on.

    from what i read, he had to register for previous sex crimes back in the 90s and never did

    The boys in blue in Colorado Springs did good. He didn't get far before being snatched up and his day in court will come along.
    I don't know how all of this shit works but the prosecution failed on a basic fundamental right as to a speedy trial so the asshole walked, however were I in some kind of situation I would want that Right upheld also. I am not a sex or any other kind of offender, just want what rights I have respected.
    Maybe it was a lawyer or some other kind of chickenshit person that let this go on, all playing fuck fuck, I don't know. Who would want to defend a person like that? None the less, the prosecution phase failed. Too much bureaucracy and a major failure on their part. LEO did their part.
    Right now he is in jail, where he belongs, and his failure to register as a sex offender is what got him there and I would bet that he was under close scrutiny from the time he walked out of the court house free as a bird.
    I don't know how hard they can hit him with what they have now but I would bet it would be the Max sentence allowed by law and once he walks out of that jail or prison after time served he won't be able to fart in public without a new charge being filed.

    Veer, He was not caught on the charge he escaped. He was caught on failure to register on previous convictions, in other words, he is a known sex offender that did not do what he was ordered by the courts to do prior to this mess.
    There is no double jeopardy, just enforcement of his prior convictions. Therein is another failure from the system as he should not have been out there to commit more crimes as he did. FM
