They can lay him off and hire someone in his place, BUT the city has to offer him some position when he returns, dogcatcher, something... Otherwise, they are in violation of T-32/S/S/A.

Sucks for him especially the timing but the city can lay him off if they can show "cause" and if the city is laying off 35 people due to budget issues, and he falls into that 35 due to seniority then he gets a lay off notice, and the city is covered.

It's not like the city is only going after him with the lay off notice. He is not being laid off because of his service, he and 34 others are being laid off due to the city having no money. He would have gotten the notice whether he was serving or not, it’s just the timing that sucks.

and if I understand correctly, with the same pay, benefits, etc. When my partner deployed they hired someone to fill in until he returned. If they'd kept the 'fill in' on then they would have found something for him to do. Regardless, he had a position with the same pay (and cost of living raise) when he got back.
