I'm unclear on this. As long as a buyer is 18 or older you can sell and ship a rifle without an ffl right? I know with handguns it's a bit different

Rifles must ship to an FFL. In some states you can ship to another resident in that state.
You can also ship rifles to someone else's address if you are coming to that state to hunt or shoot in a competition.

But keep in mind, some FFLs wont/dont like to receive from individuals so check with the FFL to be sure first

same state is ok, per ATF, for a rifle. not sure on pistols.
And anything that crosses state lines that you are not shipping to your self NEEDS to go to a FFL.

The way I have always understood it is that unless your transferring a weapon (ie selling it) you don't have to go through an FFL. That being said, I'd look into that states rules. I would never assume anything in a state like California, for example.

If you sell FTF or ship within your same state (as long as both parties are state residents), no FFL transactions are required. If you are shipping any firearm out of state, even one inch over state lines, it needs to be mailed to the FFL of the buyers choice.

I would only suggest that unless it is FTF and you know your local laws, only ship to an FFL that accepts private transactions, and always call the dealer first to make sure - don't just let the buyer say "ship it to XXY". It is not right and a pain but that's how it is.

If the person it's going to provides you a copy of an FFL check it using the ez check on the ATF website. If the FFL dealer takes possession of the rifle it's now the buyers ordeal. If he didn't make sure they accepted personal transfers they will either charge him to ship it back, charge him an extra fee for being stupid, or sell it themselves. You don't have to do the leg work as the seller.

We ship UPS everyday all day from my place of work, and I know shipping firarms is a UPS no-no. Had a customer ship a rifle to a customer of his and it was damaged in shipment and I never heard the end of it from UPS.

Bottum line is this. In order to ship a firearm it must either have a call tag from the dealer and/or manufacture. (a pre-paid label) Or it must be shipped from a license holder. You may find a store that ships UPS who claims they can ship firearms, but they are wrong. I have talked to UPS about this before as stated. Bottum line is take it to an FFL Dealer. In the case of the firearm that we shipped, it was insured at $6,000.00 and was literally destroyed by UPS. Once they realized that we did not hold an FFL the insurance went right out the window. Take it from someone who found out the hard way...

I just found that out last week actually. I usually just leave my packages over with the other packages at the UPS store when I drop stuff off since the employees are usually busy. I have shipped a couple rifles through them in the past few years too, not knowing it wasn't allowed. Anyway, I went to drop a rifle off last week, and the manager said "Hey do you mind if I ask you a question?" "Sure, whats up?" "Is that a rifle?" I told him yes, and he informed me that I had to drive to the hub to drop it off because they couldn't send it out through the UPS store. I didn't know that until he told me. Oops.

It sounds like you got screwed, but your wrong. A person without an FFL is fine as long as they ship it to an FFL Holder. Alot of the time UPS keeps businesses in their systems, but if not they ask you to provide a copy of they FFL. If you take it to a UPS Store and say it's an heirloom or skirt around the FFL then your screwed if something happens to it.

Ok -- got tired of reading this ... I just finished doing this so here it goes. If you are selling an item it must go through or to a FFL (make sure that the item is legal in the state you are shipping)- hand guns overnight and long guns can go ground.
If you already own the weapon and needs to go for service or upgrades (ie painting). It can be shipped directly to that individual and shipped back to the owner/shipper address only. Big deal here as I wanted it to be delieved to an alternat address of where I was going to be -- same state same county -- and no go .. has to go back to the orgnial address. Now how do you say does UPS fit into all of this.
UPS stores are a waste of space in my opinion as they usually deny shipping of any firearm (some exceptions) even though UPS does allow it to be shipped as long as a few rules are followed. No ammunition is permitted in the case with the weapon, no distinguising marks stating it is a firearm. That it is not being shipped to a person that has purchased it that has not gone through the FFL process. Further Signature is required.
This is the instructions that were given me at the UPS hub when I shipped my rifle out to get painted across state lines.
Now to the person that got screwed ... ya you got screwed as it is non of UPS's business if you are or are not a FFL if they find out that you are not then they can refere it to the BATFE that does not negate your claim. The reason they want properly licensed personel shipping firarms i dont care if its been your was your you want it to be your is that so johnny doesnt send his .338 lapua with a loaded round in the chamber.. I don't need a lawyer I ship thousands of packages each year and deal with UPS constantly, i'm not blowing wind. You're wrong plain and simply. Actually a handgun can go USPS Priority Mail between two FFL holders. I get them in that way all the time.

You are so messed up ... so I wasted 15 minutes of my life casue if I am wrong I will admit it. I just called my local UPS hub and asked to speak to a supervisor ... there is 5 minutes of wonderful music. Asked them the rules around shipping firearms within the state and between states. They verified what I stated and whate everyone else here has stated --YOU DONT NEED AN FFL unless you are transfering ownership !!! They gave me the section as it was our responisbilty to follow the rules. I even went the extra step and called my local FFL and asked him the same question. Same answer.
One of my friends had a saying ... no matter how well you feel .. if three people tell you are drunk -- SIT DOWN.
I mentioned that you need a lawyer cause you implied that you or a "friend" or "someone you know" lost a firearm valued at 6K.

To be more specific I have a rifle I want to sell but I don't have a FFL. If I sell to a person who doesn't have an FFL I have to go through an FFL holder?

If the buyer lives in a different state than you, then you must ship it to an FFL in that state.
In your own state you can sell directly to another resident of your state.

Having the rifle shipped to an FFL or even taken to one if your close to each other leaves a paper trail that shows the rifle is no longer in your possession. The only exception I would ever make is for Family, or really close friends. Remember if he has a problem going to a FFL Dealer there are other's that would buy it and have it shipped to their FFL.

Just tape the address your sending it to on the stock, put a couple stamps on it and lean it up against the mailbox. The mailman will pick it up in the morning.

Hey, I had a retail store dick tell me the same thing (Gander Mountain) that I could not ship a firearm. I made an honest attempt to inform him that it is in fact legal to do so and he had the same attitude of the original bone head in this thread. The same guy (Gander) told me silencers and MG's are all illegal also, go figure.
I went to the store looking for a cardboard box and got the free "education" from the gun pro dick.

You don't need a FFL to ship, You do need to ship to a FFL if out of the state where you live. Considering all the thefts these day, even in State I would ship to a FFL. UPS has different account setups in which certain items cannot be shipped aka. firearms from accounts with limits. They are not telling you take it to the hub because they dont want to ship your gun...They want to make the money for shipping your item trust me. There are ways of getting around this, such as obtaining the UPS account number of the dealer with an FFL in which the item intends to go(dealer not customer). Therefore I am basically creating a call tag with out the dealer having to mail it to me, of course the dealer will be recieving the charge for shipping. This is only if the dealer grants you thier number, some do some dont.
