Could be because she and her lawyer have chosen not to prosecute, as they work out the $ settlement with the le agency, which was mentioned in the news article, "negotiating the settlement"..
She doesn't want to prosecute there won't be any jail for him. Her choice.....

I'm drinking coffee now, and I feel like I am nearly awake. While of course I don't support the police arresting people without probable evidence of a crime, in this case it seems to me is the only people truly harmed are the taxpayers who will have to pay the settlement and the officer who (rightly) lost his job. The nurse will get a few million in the settlement.

The police union is appealing the firing and the demotion of the lieutenant to officer, so we've got to wait a bit longer to see the end of this fiacso.
We can only hope fuckstick stays fired, that the union doesn't get to negotiate a "fired" retirement for him at 27 years, where he gets paid retirement instead of having to withdraw his funds and create his future retirement. I don't know if Utah has 401 plans or a state run retirement system.

Failing to identify the nurse as a "truly harmed" party is an oversight to put it mildly, get some more coffee in your system.

The Lieutenant deal depends of several things. down here management begins at salaried captain and lieutenant is still hourly and paid ot, therefore union. I don't know what the Utah level is, just going by the different news reports that stated the union was appealing. Can only hope fuckstick stays fired..

They need to be held accountable, but that's stretching it a little, kinda like "conspiracy" charges and shit like that stretch the law. Definitely false imprisonment, conduct unbecoming and possible violation of 4A Rights, yeah.

The guy shooting the lady in PJ's ought to be charged and booked. I know that if I shot someone in the same circumstances, I'd be held FULLY accountable, and I'd be charged with a crime whether or not the victim wanted to press charges.

Not the point of my objection Diver, my point is the cop should have been arrested, just like any other citizen would have. The Lieutenant was recorded telling the detective the charges would not stick, but they would keep the nurse cuffed in the car for another half hour and tell her that her case was being reviewed by a prosecutor to intimidate her into giving access to the patient. Read the kidnapping statute. The cops violated it. Prison for the cops.

You get the police department that the elected government allocates funds for.

Did the nurse wish to file charges for unlawful detention or kidnapping?
If she does not wish to pursue criminal charges with the state, they won't file and they won't arrest.
If the FBI finds that her civil rights were violated (which is pretty damn evident), then he will be charged in federal court.

Blue only enforces the laws they believe in. Had that been you or I we would have been hooked up quick, but the badge says they have special privileges. An to some extent I agree, however when they openly violate ones civil rights, their ass needs to go to jail. Notice when that happens it's almost never been by their departments hand.
