A Utah city has reached a settlement in a lawsuit that alleged a police officer violated a man's constitutional rights by pulling him over for giving the officer the middle finger.

The American Civil Liberties Union of Utah had sued on behalf of Seth Dame, who flipped off an officer driving by on June 25, 2010.

The organization says the officer stopped the car Dame was riding in and cited him for disorderly conduct.

The city declined to prosecute the case, but the ACLU claimed the incident violated Dame's constitutional rights under the First and Fourth amendments.

Orem police have agreed to continue First Amendment protection training for officers and pay $5,000 in damages and attorneys' fees.

The ACLU says allowing police to detain people for rude behavior would give officers wide discretion to harass people.

Here in Gillette, a young man gave the Cheif of Police the finger. His ticket was breach of peace, as far as I know, he paid the fine.

Had a unmarked car behind me one night with what I thought was his high beams on. I slowed down to a crawl and this didn't help so I spead up some he just stayed right on me. I braked checked him didn't help. I go to turn into a store (winn dixie) parking lot and he passed me and I gave him the ol'finger. He slammed on brakes and turned around. I parked and he pulled up. We got into a heated talk about the light. He said his lights went with this and turned on his wig wag's. I said so what and he said they also come with this and held up his badge. I tell him his low or high beams are not set correctly that they should hit the pavement so many feet in front of his car/truck. I tell him he is in the wrong as anyone else with there lights adjusted this way and his job doesn't make him special and give him the right. Now he starts telling me he could arrest me for a felony road rage cause I gave him the finger. So I tell him I going to call 911 and have another officer come out and he quickly says lets just let it go cause we both where in the wrong and this would lead to nothing good. I thought to myself what a asshole.

On a side note I went to school with this ass hat he was a bully then and seems that he may use his badge for a bulling tool now in his adult life.


I'm not a cop basher so don't think that I know a lot of good officers but I don't think he is one of them.

I still would have called the police. Guys like him throwing out threats based upon their authority should be noted. If he's stupid enough to flash his badge as an excuse for his behavior then what else is he capable of.

The closer they get, the slower I go. Stick shift means no brake lights. And yes, I have been the guy doing 15 in a 45 because some douchebag is tailgating me. I don't care if it's an unmarked car or a regular person, you tailgate you are wrong.
As to flipping people off, well where I am from, that is an extremely fast invite to a fight, unless of course it is a fellow veteran who is a friend and goes along with a smile. Anyone else, well, it's a fast punch to the face

All I got was a stern talking to, no money... This was when I was 16; I wouldn't do it again.

There's a small city I had to drive through (on interstate) when I worked in the big city. The cops would sit on the side of the interstate and shine their spot light at cars as they passed. After being spotlighted two evenings in a row, I got my own spotlight (1 million candle power). I expected to get pulled over for ‘shinning back', but I guess they figured anybody willing to spotlight them back was not doing anything else wrong… I still keep a spotlight in the truck; is does wonders for tailgaters, highbeamers.

Cramming into 3rd when doing 50 will get some attention! In an automatic, parking brake does the same thing…

when i was 22, a young marine, was in a car with some friends driving back to Atlanta from Savannah. Car was tail gating and acting like idiots. My buddy who was driving flipped them off when they came beside us. The passenger in the other car brandished a pistol. Us being who we were, we flashed pistols back. Stupid, but that's what 22 year olds do. The other car slammed on brakes and got way behind us. 5 minutes later we were surrounded by GA state patrol in a felony stop. The other car happened to be 2 GBI agents. We had three people in the car and all of of swore that the agents brandished first. They admitted to brandishing first also. we were just responding in kind. When it was all said and done we got an ass chewing by the GSP and tn along the way. But im pretty sure the GBI peeps got a lot more than that from their boss. The GSP people were having very heated discussions behind the cruiser with the agents. Scary day lol.

Reminds me of a good laugh from high school. Like average 10 foot tall bullet proof 16 year olds, we were known to spout off to anyone in any place. While chasing tail one night in a buddy's parents' SUV, a local Officer Fife cut us off in an intersection when he ran a red light. I yelled out, "that's a red light jackass!". He wasn't running lights or sirens, so I assumed he didn't have anywhere to be. That assumption was proven correct when he wheeled around (cutting off other cars) with his lights on to pull us over. Since we were all pussies at the time, we just acted like smart-asses and said we didn't know what he was talking about. I always regretted not telling that asshole exactly what I thought of him, but kharma is a bitch. It was less than a year later that he walked into a house, sat down on a bar stool, and had a little chat with Chris Hansen on "To Catch a Predator". I like to think that he gets raped daily simply because he cut us off that day
