I'm no lawyer. and have a minimal understanding of all the jargon.
“Mr. Whitaker’s designation as Acting Attorney General violates both the Constitution’s Appointments Clause . . . and the applicable statutes,” the motion argues. “Thus, he was not authorized to sign the Rule, and the Rule cannot go into effect without violating the Administrative Procedure Act (APA) and irreparably harming Plaintiff and its members.”
so, to me this is just a band-aid to the real problem, and as soon as someone who is "authorized" comes along - the ban can/will still go into effect. it's just postponing the inevitable? At first i thought it was real lawsuit against the ban itself being "unconstitutional" or whatever. but it's just a formality saying the PERSON who signed it, wasn't authorized therefore it can't go into effect....yet.
I mean, i'm glad SOMEONE is doing SOMETHING about it. don't get me wrong. it's just not what I thought it was at first. but i guess that's the game these people have to play? can't always attack it head on, you have to strategically make moves. or is it a case of "something is better than nothing"... i dunno
