Suppressors Has anyone moved individual trusts into a gun trust?

    Majority of my form 1s for my suppressors have been as an individual. I also have my first suppressor in a living trust. I’m considering moving them all into a gun trust so it won’t be such a hassle for my family when I pass away and so they can shoot with them and technically be legal.

    Is it worth consolidating?

    do all my form1 items go back to batf jail during the consolidation?

    anyone done this before?

    Your title is a bit confusing.

    Are most of the suppressors just in your name as an individual?
    Or did you do like one of those single shot trusts for each one?

    In either case if you move them, you'll have to pay the tax stamp all over again.
    Since you already have them, you would be the one holding onto them till the new stamps come in.

    I have 3 flavors;

    1) first suppressor is a YHM in a living trust.
    2) several others have been purchased through an ffl and leveraged single shot
    3) several others through form 1 DIY build your own as individual
     
    Probably the biggest down side to doing it is the $200 NFA transfer fee for each item. Each responsible person will have to be fingerprinted and photographed for each item.

    Post death Form 5 transfers really aren't the headache they used to be. The transfers are tax free, but the recipients still have to be fingerprinted / photographed.

    If you have a lot of family members that like to play with your NFA items, putting them in the trust may be a good solution.

    Get a better trust.
    Find a good law firm in your state that knows how to do NFA trusts specific to your state.

    A well designed trust can work very similar to a corporation where responsible parties can be added and removed by having the correct notarized forms, with no need for the ATF to be involved.

    It's why it's worth spending the money for a specialist law firm on it.

    It will be 200 bucks a pop all over again to move your cans to a new trust
     
    Several years ago I created a trust and did the paperwork drill to transfer a couple cans, an SBR and a sub-gun to it. Yup, it's $200 per item again. Pricey, but I didn't want my family facing problems when I croak. It took a full year for the paperwork to be processed and then there were a couple problems that needed to be corrected. The agent who was processing my paperwork was very helpful.

    I don't remember how much the trust paperwork cost.
     
    After my first can I decided to go with a trust for my second. I ended up resubmitting the first can and paying the $200 to put it in the trust.
