I need some help on a legal matter

Long Story short and I am not leaving anything out.

In October I purchased a used truck a 2001 chevy silverado from a used car lot in missouri. I traded a 2002 ford explorer and 3500 cash total 7500 for the truck.

one month ago the reverse went out on the tranny. and when it started to snow under the door the spray paint and what looked like paper mache came off exposing tons of rust. even on the truck frame it looked like rustoleum or poorly applied because you can see it was touched up.

But the real issue is that you will pay more to an attorney than the dollar value of your problem. So, you don't have a legal problem, you have a business problem. And here's some business advice:

You won't get offered your money back and you won't get another truck. Don't waste your time trying.

You bought a used truck. It had an odometer. How much he drove it before you bought it doesn't matter unless he turned back the odometer - then you might have odometer fraud, but you would need an attorney to properly pursue a claim like that.

The default rule is 'buyer beware.' Look to the warranty you got with it; whatever rights you have will be found there. You probably purchased it 'as is' and signed a window sticker that says so, in which case you could have/should have done your own inspection and you're screwed.

Beating someone up over it would be a crime. And judges make their minds up on the facts and the law, not on the basis of your race. Get real. I know you're upset, but maybe reconsider announcing and memorializing your intent to commit assault.

I suggest that you ask a lawyer in your state about any MO consumer protection statutes that might apply. But know that this kind of stuff happens all the time. Chalk it up to a lesson learned, and next time choose with better care those with whom you do business.

Well the first and most important piece of advice I'll give you is to STOP ASKING FOR LEGAL ADVICE ON AN INTERNET FORUM. You'd be better served by talking to a lawyer if possible.

Research your states "Lemon Laws" and see what you can come up with. Many places offer consumer protection against these sorts of things

Lastly, if you're gonna beat the guy up, don't advertise it on the internet.

I am assuming you bought this "as is"? In the event your state has a lemon law on used vehicles, you may have a remedy. You'll need to consult with an attorney, especially if you take the advice given above

Sure, you were probably taken advantage of. But, maybe learn from it and be wiser next time.

i learned my lesson. always buy new or from a large dealer. these small town or fly by night dealers need to be avoided. your right, after hearing horror stories and i still go and do what i was warned not to do.

Sounds like someone failed to do a proper inspection before buying a POS truck. My guess is you bought 'as is' either way, so just suck it up and drive on, AND learn from your mistake.

You ASSumed you were getting a fair deal from a small time used car dealer - mistake #1. I doubt you have any legal recourse unless it was spelled out in the purchase agreement that the truck did not have this particular problem.

We had a guy locally who did something like that.
He had a big sign with a lemon on it. I mean a BIG sign, like friggin billboard almost.

"I Bought My Lemon At ________ Ford"

He paraded that thing around for about 6 months before they reached an agreement and made good on it. Local paper did a story. The whole bit.

And it is a vehicle from Iowa - I spent 1 month there and saw NEW (1 year old) cars with rust on them - they way oversalt the roads there!!!!!

Live and learn. You just paid $7500 tuition to learn that you should have:

1. Bought a new truck.

2. Not bought from a used car lot.

3. Had the truck professionally evaluated before purchase.

Let me get this strait, YOU bought a ten year old truck. YOU traded a nine year old truck for it. YOU live in a part of the country that puts more salt on the road than Mickey D's puts on frys. YOU didn't look under said truck. And now YOU are seeking legal advice on a shooting forum. I think stupid should hurt, bad. I've got a great 1972 MG that only has a small wiring harness problem that I'd let go for two grand.
