I believe what you've described is "constructive possession", which has indeed landed some people in trouble. The equivalent situation with a solvent trap would be to drill out the baffles and end cap, but not screw everything together. I do believe the ATF would frown upon that in absence of a tax stamp.
But once again, I've yet to come across an actual conviction of anyone for illegal silencer possession solely because they were in a grey area. It's almost always something like a convicted felon with multiple completed devices (and firearms) trying to distribute them illegally. It's almost certainly happened at some point in the last 86 years, but if so, it would seem to be relatively uncommon.
This has me in a dilemma. I myself want to make a few form 1s and if it wasn't for 2020 being such a epic shit show of biblical proportions I probably wouldn't be in one.
One one hand I'm half tempted to buy all the internal parts in one shot even before the stamps come back to plan ahead in case the price goes up or they become unavailable due to wait or no longer being manufactured. However purchasing enough for 3 suppressors can add up quick.
On the other hand I don't want to get flagged and visited because I purchased enough for 3 cans. None of the cups will get drilled out until the stamps are approved and returned but still that's quite a few cups all in one purchase and it might raise some flags with the ATF.
I already have a few form 4s in my possession so its not as if I'm trying to do anything shady. The current form 1 wait time over the form 4 wait time is enticing and honestly its fun researching the design so why not?

A few years ago the ATF reported that they only only prosecute 20 or so NFA crimes a year. And almost every one it is a paperwork crime. They wouldn't elaborate on that, but every so often there are reports of manufactures or dealers getting raided and full auto guns are either missing or there are several present that are not on their books. A few years ago I became aware of solvent traps at the same time the Feds shut down a company selling them. And that campany were being stupid about it. It was clear in their ads it was for a DIY can, just were not calling it a can to keep you off the grid. Wink Wink. "Works great with your 556 and 308 engines!" And the dumb thing is others have not learned. Saw another company pulling the same stunt FaceBook last week. I work with a retired ATF agent. Cool guy and some interesting stories. The thing to remember is they are small when compared to federal LEOs. And most of the time they are looking at manufactures to FFLs to keep guns from getting into bad guys hands. So if the ATF is interested in you as an individual, you did something that got their attention.
Flying, I would call the ATF and explain what you want to do and what their stance is. Or check the website on their FAQ and the NFA handbook. I know they got snotty about keeping spare wipes for cans that used them. But with the explosion of modular cans hitting the market, it does seem contradictory that one set of spare parts is bad and another is good. Especially since one is only good for a magazine or two before needing replacement. But getting them to give an opinion on how to build a can yourself legally is the best advice I can give.

Pretty sure having a FA FCG and an AR is not a problem. Unless those parts convert it into a MG without further modifications to the AR, like a DIAS or wire fashioned into a sear trip. Drilling the lower to accept a FA FCG is the problem, not having the parts. It is the drilled lower that gets you in trouble because it is, according to the ATF a MG in and of itself even if you have no other AR parts. A DIAS is, and of itself, is the MG regardless of anything else you own. A DIAS serves no other legitimate purpose other than to convert a AR into a MG>
I have absolutely no plans to drill until the stamps come back but its the purchase that has me in a dilemma. The cups I want to purchase for 2 rifle cans are from Lucid, which aren't even in stock but are on order and are 4-8 weeks out. That should give me enough time to get the paper work done, turned in and back before the cups arrive. However I plan to make a pistol can as well and I will have to order from anther company the pistol cups. Making two purchases for the internals more than anything its what weighs on my mind.
Call the ATF. It is better to get their advice since they are the ones who set the rules. But this is one of the times it is better to ask permission than forgiveness. And if you can get it in writing on letterhead, even better!
My solvent trap / fuel filter from Aliexpress works great!
It's not as nicely made as my DPT or Parker Hale cans, but is easily as quiet. Although I don't have a bolt action .22 threaded 1/2x28 to test it on, only the M&P 15/22, so there's a bit of action noise.
I had a friend with a lathe drill the baffles and away I went. Can't complain for $16NZ (About $11USD) to my mail box.
I'm going to order a couple of the ones with the one piece baffle to try next.
