Update: Bill passed out of comittee with this language concerning silencers.

B. It is unlawful for any person to import, sell, transfer, manufacture, or purchase a silencer,
provided that a person may transfer a silencer in accordance with the provisions of the National Firearms
Act (26 U.S.C. § 5801 et seq.). A violation of this section is punishable as a Class 6 felony.

The House committee on Public Safety meets the last time to consider new laws on Friday morning. HB 961 with the AW, Magazine and Suppressor bans will be voted on to move it to the floor for a full vote. All Virginia residents who have suppressors should call the members on the committee and point out that suppressor owners are the most vetted firearm owners and that purchasing one is a very long process not a heat of the moment decision. When the original law allowing them in Virginia was passed in 2009 it was with a vote that was 33-5 in Senate and unanimous in the House.

UPDATE: A substitute bill passed out of committee that dropped the word "possess". As related to silencers it now reads as follows. However the bill may be amended so don't let your guard down until the governor signs the final bill.

They also dropped requiring registration of assault firearms with State Police and dropped the word "possession" in the AW ban. But banning the sale of parts to assemble an assault firearm is still in it as well as all the things they consider as being an assault firearm.

It still states can't transfer or purchase, that means no more.

Must be stopped, because I dont ever see this getting repealed, or ruled unconstitutional.

As others have pointed out it is all part of Bloomberg's playbook. They will pretend to compromise by backing it down this year. Then next year start tightening it up a bit until they eventually have full control.

It will happen nationwide if this country elects any of the democratic candidates for president. That will embolden states to push through all sorts of socialistic agendas that need to have citizens disarmed .

I went by Greentop in Ashland where I bought my suppressors back in 2018. I listened in on a conversation with a perspective customer. The sales guy said if you bought a suppressor today and did not receive the tax stamp before a ban went into effect, you could NOT take possession of it and Greentop would refund you the money you paid for the suppressor.

In other items of interest, they had stacks of Ruger AR-556 for $629 and plenty of 30 round Pmags Gen 2 for $11.99 on the sales floor. I saw 3 people filling out paperwork for rifles in the 10 minutes I was in the store this morning.

my read is that i would have purchased (and green top etc would have sold) that suppressor before the law took effect. as such, thee would be no importing, transfering or manufacturing going on after that date. i am not sure of the nfa/atf technical def'n of 'transfer' but the language does say that is ok if in accordance with nfa. i would merely be awaiting successful results of my background check to take physical possession. now obviously i would have to find another dealer other than green top because they're reading it differently.

I think the jest of it all at this point is to see what the final bill if it is even passed at all says. Then the finer points can be distilled by those who know for sure. Speaking of which don't ask Del Levine as we all know what he would say.

When I was shopping for mine, Colonial Shooting Academy would allow you to shoot your suppressor in their range until you got your tax stamp. Good deal for them since you would be paying to use their range. So I would assume from their viewpoint that you were in possession at the time you paid for it, just not legal to leave their premises. Or they may have viewed it as "renting" until it was officially yours. I didn't look into since I was buying one for my 7mm Deer rifle.

Look up the 26-5801 reference

You will find that it's in reference to the SOT tax rate I believe

In other words... They can do form 3 from SOT to SOT...

That doesn't help those of us that did a form 4 in October... November... December... (Before this CRAP bill was even introduced) on a trust and that approval won't come back until after this crap kicks into law!

Because now my can is going to be stuck in eternal limbo if they can't transfer it to me after July 1... Because I already paid the original vendor for the can and had it form 3d over to my SOT and paid all but $1 of the transfer and did all my paperwork.... Waiting for my year to go by ... And while I'm waiting a year they wanna pass some junk to tell us we can't have what we purchased legally and jumped through all the hoops for....
 
I’m in Virginia, I just bought a Thunderbeast .338SR and a .308 Ultra 5 this week. I’m rolling the dice that I actually own the suppressor the day I bought it, just waiting on the stamps. Just my way of say FU to all these crazy politicians.
