Michigan members-who wants a suppressor?

Re: Michigan members lets get suppressors legalized

Adam, it's not that suppressors are illegal in Michigan, it's that those who have tried could not get a ATF Form 4 for one.

That's why people are demanding an AG opinion on 'silencers' consistent with the existing AG opinion on MG's other than Curios and Relics - it's the same statute.

Edited to add:

I'm not saying that it's legal to have a suppressor in Michigan without a Form 4, I'm saying that the same statute applies to legal ownership of 'silencers' that applies to MG's, but the snag for the individual is getting the ATF to issue the form with the State Police taking the position that they will act as if a 'silencer' is not lawfully possessed without a specific AG opinion in place.

Re: Michigan members lets get suppressors legalized

Politics is politics. I stay out of it as much as I can. But you're right, we do have a new governor now.

Re: Michigan members lets get suppressors legalized

FYI: Here's the statute:

750.224 Weapons; manufacture, sale, or possession as felony; violation as felony; penalty; exceptions; "muffler" or "silencer" defined.
Sec. 224.

(1) A person shall not manufacture, sell, offer for sale, or possess any of the following:

(a) A machine gun or firearm that shoots or is designed to shoot automatically more than 1 shot without manual reloading, by a single function of the trigger.

(b) A muffler or silencer.

(c) A bomb or bombshell.

(d) A blackjack, slungshot, billy, metallic knuckles, sand club, sand bag, or bludgeon.

(e) A device, weapon, cartridge, container, or contrivance designed to render a person temporarily or permanently disabled by the ejection, release, or emission of a gas or other substance.

(2) A person who violates subsection (1) is guilty of a felony, punishable by imprisonment for not more than 5 years, or a fine of not more than $2,500.00, or both.

(3) Subsection (1) <span style="text-decoration: underline"><span style="font-weight: bold">does not apply</span></span> to any of the following:

(a) A self-defense spray or foam device as defined in section 224d.

(b) A person manufacturing firearms, explosives, or munitions of war by virtue of a contract with a department of the government of the United States.

(c) <span style="text-decoration: underline"><span style="font-weight: bold">A person licensed by the secretary of the treasury of the United States</span></span> or the secretary's delegate <span style="text-decoration: underline"><span style="font-weight: bold">to</span></span> manufacture, sell, or <span style="text-decoration: underline"><span style="font-weight: bold">possess</span></span> a machine gun, or a device, weapon, cartridge, container, or contrivance described in subsection (1).

(4) As used in this chapter, "muffler" or "silencer" means 1 or more of the following:

(a) A device for muffling, silencing, or deadening the report of a firearm.

(b) A combination of parts, designed or redesigned, and intended for use in assembling or fabricating a muffler or silencer.

(c) A part, designed or redesigned, and intended only for use in assembling or fabricating a muffler or silencer.

And here's the AG Opinion on pre-'86 machine guns:

Now, can anyone explain to me why the same reasoning does not apply in the same statute to 'silencers'?!

Re: Michigan members lets get suppressors legalized

Seriously, suppressors need to re-classified as safety devices and the Feds should be giving us discounts on them because they save shooters hearing! BTW, here in michigan our newly elected governor is more akin to a RINO and I doubt if he would support something like this. But if it is up to Cox our AG, I am baffled why he hasn't made an clarification on his opinion on this topic. Its been years.

Re: Michigan members lets get suppressors legalized

FWIW there is a request sitting on the AG's desk for him to issue a opinion on this issue, but "it is low on the priority list"

Re: Michigan members lets get suppressors legalized

Explain this to me.

(a) A machine gun or firearm that shoots or is designed to shoot automatically more than 1 shot without manual reloading, by a single function of the trigger.

As I read it. You are limited to lever action, bolt and pump weapons.
