so all this time i thought you had to be 21 to posses nfa items such as a suppressor. i went up to my local dealer that sells suppressors and we were chatting and he seems to think that that is not a requirement. here is the situation....

I am 21, my wife is 19, the question presented was can i put her on my trust and can she posses the can with-out me there.
He said that there is no 21 age requirement, that anyone that can purchase a firearm can purchase a suppressor, is the 21 thing a state law in some locations or federal? does anyone have some documentation or a link to the actual law or code that states the age requirements.

Thanks!!!!

PS. i searched with out much in the way of straight answers

Re: nfa age req????

Federal law mandates one must be 21 to purchase Title II items from an FFL/SOT, but at 18 one can acquire Title II items from an individual (non FFL). Individual state laws may trump this.

Further, although it seems okay to add your wife to your trust, I don't know how this would affect the transfer from your FFL/SOT. You may be able to transfer the suppressor from your FFL/SOT now and then add your wife to the trust later.

But is that state or nationwide law? I have been under the impression, from my interpretation of the law, that you had to be 21 to buy or posses the NFA item.

Re: nfa age req????

So let me ask this question in a different way. Im 19.

I can buy a suppressor or other NFA item (sbr, automatic, etc) from an individual who is not an FFL dealer and it be perfectly legal? How does the paperwork and stuff work for transfer of an NFA item from one individual who is not an FFL dealer to another individual who is not an FFL dealer? Surely there are forms and such? Can anyone show me a point blank, written law that states that I am allowed to own an NFA item at 18?

Re: nfa age req????

Forgive my ignorance on the subject, I don't know anything about suppressors really. Say I find someone in my state who wants to sell me a suppressor. I fill out the form four and send it in with my tax stamp payment and then when it gets approved they send me the approved copy and I can pick up the suppressor? Or do I need to go through an FFL? Same concept if I was to build an SBR. Also isn't the SBR tax stamp 5 dollars instead of 200?

Where in Texas are you located, and which suppressor/caliber do you want to purchase?

BATFE usually sends the approved Form 4 to the tranferor (seller).

In Texas you do *not* need to go through an FFL/SOT for an in-state transfer of NFA items from one individual to another.

The tax stamp to manufacture or transfer an SBR is still $200.
The tax stamp for an AOW is $200 to manufacture and $5 to transfer.

Re: nfa age req????

Awesome reply thanks!

Im down in Beaumont, in the future id like to get a suppressor for my 6.5 and for my rimfires. I havnt don't much research because I was under the impression I had to be 21 to own a suppressor.

Re: nfa age req????

You can form 1 a gun if you are 18. You can get NFA stuff on a form 4 from individuals in your state if you are 18.

You cannot get any NFA items from a dealer unless you are 21.

Re: nfa age req????

So i can apply for form 4 approval to build an SBR, send it in with my payment for the tax stamp and then when its approved they send it back to me and i can get started on the build?

Form 1 instead of a Form 4

I think this is the form that you're looking for.

Re: nfa age req????

Oh that's right its a form 1 to build, and a form 4 to transfer right?

So when I send out a form 1 it comes back directly to me approved?

And I can make my own suppressor too on a form 1 and it be legal right?

So many questions. Once again please forgive my ignorance.
