Private rifle sale in New York?

I have a neighbor who has been a very close long time family friend that is willing to sell me a rifle he no longer uses. Has anyone done a private sale/transfer in NY state? All I could find on the ATF site is below but it seems too easy, especially considering all of NY's other ridiculous gun laws. Just want to go about this the proper (legal) way so any help would be great. Thanks in advance.

Q: What record-keeping procedures should be followed when two private individuals want to engage in a firearms transaction?

When a transaction takes place between private (unlicensed) persons who reside in the same State, the Gun Control Act (GCA) does not require any record keeping. A private person may sell a firearm to another private individual in his or her State of residence and, similarly, a private individual may buy a firearm from another private person who resides in the same State. It is not necessary under Federal law for a Federal firearms licensee (FFL) to assist in the sale or transfer when the buyer and seller are “same-State” residents. Of course, the transferor/seller may not knowingly transfer a firearm to someone who falls within any of the categories of prohibited persons contained in the GCA. See 18 U.S.C. §§ 922(g) and (n). However, as stated above, there are no GCA-required records to be completed by either party to the transfer.

There may be State or local laws or regulations that govern this type of transaction. Contact State Police units or the office of your State Attorney General for information on any such requirements.

I'm thinking I will call the local police to be safe, but thought I would check in here first to see if anyone has actually gone through with this procedure first hand. I am not in NYC or the boroughs btw.

Speaking in terms of the Feds you have it in right there in black and white. Private firearm sells within ones home state require nothing. But local and state regs may vary. I would look local laws and read for yourself or call an attorney and consult with them if you feel uneasy. The police really are a good source of legal advise.

Unless Westchester County has a different set of laws than the rest of the state (take nyc for example), there is nothing against private transfer that i know of.

Private sales between individuals aren't subject to reporting. I've lived in NY most of my life and can tell you it's perfectly legal, no worries at all. Enjoy your new rifle.

The only thing I do is get a copy of the sellers drivers license,and give him a copy of mine and keep for your records.It's just a "cover your ass" thing with me.

Thanks for all the NYers showing up! One more question- since i know this person very well and have no doubts about the gun, where it came from or his intentions selling, I am totally comfortable with this transaction.

But on the other side with a stranger, how would you know that you aren't taking possession of a stolen rifle? or rifle connected to a crime of some sort? Since they all have serial numbers like cars have VINs, is it something to worry about being in possession of? Or am I totally over thinking this? I was at a gun show last weekend and was wondering about this with guys selling guns privately.

Serial numbers can always be run. Just a quick your local law enforcement agency can run the serial number to see if a firearms is stolen. The serial numbers of stolen firearms go into a national database so LEOs can run them for the exact purpose to tracking stolen firearms.

I think you are overthinking it brother. I would just get the personal info of anyone you are selling to. If something happens you know who sold you the rifle.

I will say I woudn't deal with some jerk-off gansta or someone off the street, lol...
