If the kid put his money up front on this then the dealer didn't put up a dime of his own change.

I wont do business with a gun shop that makes you pay up front to order an item. I can understand the policy but I do not ask for something if I cannot afford it. I know most small ops cannot afford to do this, but the shops I deal with know me well and know my money is as green as the next guys.

best option is getting your money back, by the time you have it sent to a CA FFL and pay him you out nearly a bill anyway plus drive time.

True, but I feel that it falls under sound business practice and good customer service. Say he does stay in the area and gains residency or otherwise becomes eligible to purchase firearms in AZ- Would he really want to deal with that shop again now that he has a bad taste in his mouth over them? I'd say no.

He is wrong, thats for Pistols or "Assault Rifles" only, He can sell you the bolt rifle no problem, have him call the ATF while you are there. They will fill him in. Alot of gunshops are ignorent to the law. its ever changing and you actully have to read them and keep up with them to understand them. most dont put in the effort. It may be an AZ state law thing that I would not be awhare of.

George with all due respect, I agree that 'Alot of gunshops are ignorent to the law', but what I said earier is the case. I don't want to paste the entire thing here, but where the law is found is: [18 U.S.C. 922(b)(3)] It states that for a long gun (rifle or shotgun, and can't be just the action), you can trasfer to an out of state resident, Providing that all of the laws in the state of residency are followed. But this is basically saying, the same thing I did. If the state of residency has stricter waiting periods on long guns (see my definition above), then the state of sale, the dealer can't make the sale. This is all due to the waiting periods (of which California has a 10 day waiting period for all firearms). This is only applicable to long guns, as you can't transfer a handgun (or even a receiver as it is considered a non-long gun) to a non-resident.

If need be I can turn up more information perhaps talk to an ATF agent (who will basically give their interpretation of the law), or search for a previous ruling on the subject.

(F2) May a licensed dealer sell a firearm to a non-licensee who is a resident of another State? [Back]

Generally, a firearm may not lawfully be sold by a licensed dealer to a non-licensee who resides in a State other than the State in which the seller’s licensed premises is located. However, the sale may be made if the firearm is shipped to a licensed dealer whose business is in the purchaser’s State of residence and the purchaser takes delivery of the firearm from the dealer in his or her State of residence. In addition, a licensee may sell a rifle or shotgun to a person who is not a resident of the State where the licensee’s business premises is located in an over-the-counter transaction, provided the transaction complies with State law in the State where the licensee is located and in the State where the purchaser resides.

(B2) From whom may an unlicensed person acquire a firearm under the GCA? [Back]

A person may only acquire a firearm within the person’s own State, except that he or she may purchase or otherwise acquire a rifle or shotgun, in person, at a licensee's premises in any State, <span style="font-weight: bold">provided the sale complies with State laws applicable in the State of sale and the State where the purchaser resides.</span> A person may borrow or rent a firearm in any State for temporary use for lawful sporting purposes.

OP has a CA DL he can't get any weapon in any other state because CA has a 10 day wait. CA law states, with a few exceptions, that any buyer of any legal weapon must wait the 10 days. AZ doesn't have a 10 day wait. The reason the FFL in AZ won't sell it is he is following federal law and ATF guidelines.

The OP needs to get an AZ ID to do the transfer to comply with Federal law, ATF guidelines, and CA law, pieriod.

So George,if a person came to your shop and wanted to purchase a rifle, he provides a Missouri address on the 4473 and when you ask him for his gov issued picture ID to prove identity, in this case a California Driver's License you will proceed with the sale? Isnt a correct current address required?

California acts as it's on POC and has a 10 day waiting period.Even federal law can not superceed that.
I dont know about other states but here in Texas in order to proceed the firearm is paid for but would have to be shipped to an FFL dealer in Ca and the 4473 would be completed there. After the mandatory 10 day period he would then be able to receive the firearm into his possesion.

Just my thoughts..... I have been wrong before though

Doing that on monday. I called up the owner and he was confused as to why they didn't tell me that on thursday when I went in there.

Damn DMVs not open on the weekends...what a drag.

At least I get my rifle =D

I would think you would want an AZ residency anyway if you are going to school there. Isn't tuition cheaper for a resident than an out of state student? Unless things have changed since I went to school you should be able to save some cash.

Couple of points:

* The AZ dealer can send the rifle to a CA FFL holder only if the AZ dealer is preapproved by the CA DOJ. That's why there are a lot of gun dealers on Gunbroker.com who won't sell to anyone in CA - they have to file the CA paperwork to be preapproved to ship to CA.

* If you have an AZ residence (dunno whether this applies to a college dorm), then you may be eligible for a seasonal resident ID in AZ, if they have one. I know that NV has such an ID and you can purchase a gun in NV with it.

* Before the CA preapproval requirement, I bought a couple 22LR rifles in TX and they had to be shipped because CA has a 10-day waiting period and TX does not.

If you are going for an AZ DL, then you will have to give up your CA DL. You can have only one state's DL at a time. Also, if you have a car in your name, you may be required to get AZ licence plates and insurance. Sometimes life is more complicated than you imagine and it's usually not inexpensive - something about entropy always increasing.

Ok so here's the AZ law deal. The law <u>only</u> requires an Arizona <u>identification card</u> for long rifles, pistols and shotguns. If you have an address in AZ (I'm in an apt, but I'm sure a dorm would work as well) you just have to visit the MVD and apply for an ID. You do NOT need a drivers license, just an ID.

When you go to the MVD, make sure you have 2 forms of identification (mine was my california drivers license and a credit card with my name on it[note credit card was registered to my california address on it, so that shouldn't matter]).

It cost $12 and will be given to you immediately after you are done. If they tell you they want to mail it or some bullshit, stop what you are doing and verify you just applied for an ID and not a drivers license. If its an ID but they want to mail it, stop them, get your money back and go to another MVD. You aren't suppose to wait.

Pro-tip, when buying from a gunshop, don't let them see your other ID/drivers license as they may not understand and refuse to let you fill out your forms.
