If you're not a 100% Constitutionalist, then you have no business being a Supreme Court Judge. PERIOD!

The problem is that the far left realized decades ago that they could not win a progressive/Communist/Socialist agenda at the ballot box. It's not an appealing message. In addition, they recognized that any Constitutional Amendment has too high a bar in this era of mass communication and, yes, mass polarization. The Equal Rights Amendment failure in the '70s and '80's... the feminist wet dream... confirmed that.
So they instead created a strategy to use courts, at all levels, to re-interpret the Constitution without amending it. To declare that it was a living document through interpretation, not Amending. Which is NOT what the framers intended. They did, in fact, intend the Constitution to grow and be a living document. But they put a very high bar around the process... the Amendment. So that it could not be changed on a whim.
By re-interpreting (and I'll argue that these re-interpretations are not appropriate) through the courts, any leftist judge in any po-dunk backwater can change the Constitution by saying "This is what it means now."
This is why judicial appointments, who is POTUS and who controls the Senate matters so much. And why Harry Reid's invoking the nuclear option on judges... matters so much. Because it's now all about judges and justices.
As I have mentioned before... the Constitution, the Bill of Rights and the Amendments lay out what government can and cannot do. Including things like voting, property rights, etc. etc. etc. The left realizes that the documents prevent the arrival of the bright shining path of socialism. So they have to work around it... How?
Through the judicial system. By importing voters. By eroding voting laws. Gerrymandering. Propaganda. Physically attacking those who oppose them. Newspeak.
Orwellian nightmare come to life. Just as he predicted. Only Orwell intended it as a warning, not a roadmap.
The good news is that the number of federal judge appointments our current POTUS has been able to get through is amazing. If RBG snuffs it soon... he gets another and probably one after that. The Dems are claiming that once the campaign starts next year, he can't appoint a justice. Not true. That has traditionally only applied to a president in the last 6 months of their SECOND term. When their departing office is guaranteed. RBG better hang on a long time.
And, likely, Thomas will retire after RBG goes, letting Trump appoint another young Constitutionalist justice.
