So, if you listen to the headlines, guy was being cuffed and officer comes out of nowhere and kicks the subject in the head.

Actual story:
Subject is fleeing police for a felony (grand theft auto I believe), gets cornered after lengthy chase and while one cop is attempting to handcuff, the other cop runs in “pretending” attempt to kick the subject in a seemingly distractionary effort to help keep the subject compliant.
There is even body camera footage of the suhject making fun of the cop for missing and the cop telling him he pretended to kick him in an effort to keep him compliant.
Somehow, Miami has charged the cop with assault.
1: there is no way this will ever get a conviction as there is even video of the subject making fun of the cop and the cop telling him it was an effort to keep him compliant
2: this is a waste of taxpayer money as I can almost promise you the prosecutor knows this will never see a conviction
3: the city will likely have to pay a civil suit to the officer for wrongful arrest and dragging his name through the mud
This is what all this mostly (keyword) unsubstantiated media frenzy against police has culminated with. Prosecutors bringing ridiculous charges they know will never stick against cops just for popularity.
Same thing happened in Baltimore. Prosecutor brought ridiculous charges against several cops and ended up looking foolish in court on the first few cases and dropping charges on the rest. All whilst spending taxpayer money.
Almost 100% chance the defense requests a bench trial and the judge laughs while dismissing the case.
