I've downloaded tons of stuff (all legal, mind you) with uTorrent and still use it regularly. Never got any sort of malware, but I could just be blessed. It never hurts to virus check the file before you open it.
Be aware that a lot of the file swapping that goes on violates copyright law (remember Napster?), and running any sort of a bittorent client will raise your Internet profile with los Federales. And last Friday, three of the creators of the world's largest torrent website (thePirateBay.org) were sentenced to several months in the crossbar motel and fined more than $5 million for facilitating the downloading of copywritten material.
People in the US who get charged with illegally swapping files usually get charged by the folks who make sure the musicians get paid their due for the stuff they record, RIAA. You rarely hear of anyone getting busted for swapping anything other than music.
