What’s more important: Trump Reelection or a Conservative SCOTUS RBG replacement?

Tough call, but it looks like one likely won’t happen (Conservative RBG replacement) if the other does not (Trump reelection).

But let’s say a forced SCOTUS pick loses Trump the 2020 election.

    Is it worth it?

Good question The Horta. I'm torn on this. Critical to get a real Originalist on SCOTUS. However, there will likely be 2 if not 3 retirements in the next 4 years. The more critical question is will Trump have a republican senate if he wins? That's the key thing. If he pushes a judge through now, he may not if he wins in November (still doubting this myself). If we could assure his presidency and then having a 5 person majority in senate, that's what we need. But...I just don't think it's there.

I think the press has completely brainwashed the stupid masses of the American people who are more concerned with their social media/facebutt and macbook pro 15" (saw people at Costco looking at 15" MBP's that maybe have income of ...oh, wait...no income expressing how their year old has a different keyboard). Easy to brainwash idiots who instead of saving their money and living within their means are living on OUR means. So if he pushes, the press is just going to go nuts and most people will believe it - like my ignorant libtard neighbors.

Also murCOWski and collins have said no vote. SO you know puff romney will not vote because he is ashamed of his lack of manhood . These three need to be kicked out...period. the COW should probably be in jail, and collins should just be an independent - that she actually believed for a point the rumors with Kavanaugh was disgusting. Romney, he needs to become a crack addict.

In the past I would have said scotus. We are now at critical mass though. It's a time honored cliche *this is the most important election of our lifetime*, but we have to understand, this IS THE MOST IMPORTANT ELECTION IN THE HISTORY OF OUR COUNTRY! Donald Trump has been such a disrupting force to the deep state and the communists that they have thrown in all their chips. If we lose this election, a free America will never exist again, at least not without another revolution against tyranny. Certainly not within a political realm. The communists (we can no longer call them democrats) will change every thing. Puerto Rico statehood, DC statehood, dividing California creating new senate seats and creating a virtually unbreakable majority in the senate. They're already dedicated to adding, or trying to, more Supreme court seats to the bench creating an unbreakable majority in scotus.
There are two likely outcomes, both requiring us to rise up against the coming tyranny.
    1) Trump is no longer our president and we have to fight, literally, for our freedom againt our now totalitarian government.
    2) Trump remains our president and we still may have to fight, literally, for our freedom, but we fight along side our duly elected freedom supporting government.
All that being said, President Trump should put forth a nomination and the Senate should vote to confirm, ASAP. Would we expect anything less of the communists?

Maybe SCOTUS, but really considering the amount of case that they hear, and how the District courts have over the past few years have basically said, the government is all powerful and all knowing, hence they can do anything they want.

Trump was ok, so I would have no issues with 4 more years.

At the end of the day, I really think all of this is just political theater. 99 percent of the people that are outraged I would wager as never even reading one paragraph from any of her decisions. Same thing with the protest, almost 100 percent of the people are being targeted in these protest absolutely support the protesters message and demands.

    Also

Didnt the 4 republicans already say they would not vote for a replacement so even the Trump suggesting a nominee is theater.

Flush out your head gear it's more like if we don't do what needs to be done we are fucked , plain and simple.

I am going with both . make his pic and laugh in the faces of the pro socialist democrats force the rip party to get off there lazy asses and work you know the dims are . They have lied cheated and supported terrorism in this country quit playing nice guy and put some skin in the game . Let them say they wont vote then cut them off of rip funding for reelection . loosing 4 seats is well worth cutting the fat push new republicans to run in against them in there states stop supporting democrats that want to play as republicans when they clearly are pro socialist .

To paraphrase Stalin, "How many divisions does the Supreme Court have?"

Let's say that a new justice is confirmed to replace RBG, and that this justice is a "perfect" conservative. How long does it take that justice to begin altering the trajectory of the Court? (Which is always and forever "just one more conservative justice away" from making the right decisions, whatever the hell that means.) Compare that to the speed in which things may very well go downhill with Biden/Harris in office along with a new Democratic majority in the Senate.

BTW, isn't this whole topic setting up a false dichotomy? I mean, let's say that the Senate doesn't seat a new justice prior to the election, and then Trump wins a second term and retains a Senate majority. Doesn't he just start off the second term by, I dunno, nominating a new justice? What we're really talking about is altering Trump's odds of being elected and retaining the Senate. Maybe they're slightly lower if he forces through a nomination (I'm not convinced that this is true), maybe they're slightly higher if he punts until after the election, and certainly the confidence interval of this prediction of these odds in both cases is so wide as to make attempts at prediction a fool's errand. More than anything else, it strikes me as an exercise in mental masturbation.

It need not be a choice of one OR the other. DJT was elected largely to ensure conservatives were placed on the SC. If he gets another one in place before the election, it can only help his re-election chances. The left could not possibly hate him more, so absolutely no need to placate that bunch. BTW, isn't curious how, suddenly, social justice and covid are no longer front and center? There is new issue du jour. If you think there was violence and chaos before, just wait. Buy/make more amnmo.

MSM taking the focus off the riots/protests.....it's working already. Now if those people were smart the riots would suddenly stop, then there would be no other issue to chant on the news. The sheeple would vote Biden in.....

So just hope that the protests don't stop....I'm comfortable saying looting and riots effect my life more than some "decision" by the SCOTUS.

BTW.....lay out the decision made by SCOTUS that has substantially changed your life in the last 10 years. I'd like to read what the decision was, and how it directly impacted your daily life.

I don't really disagree, but would only add that despite, Biden and Harris not exactly being fan favorites, I think that the DNC via state and local governments are doing everything they can to tip the scales in their favor in broad daylight.

I really don't think Trumps actions in regards to pushing a nominee forward are really going to have a significant impact on the DNC base. I say this because even before RGB passed they were still disgusted by Trump and were going to vote against him this go around.

This scenario doesn't magically double the amount of upper middle class, college educated females who are really they only people freaking out about this. Nobody else really cares about this issue and for them, they were already all in. Just like how gun people are all in on Trump despite him not really coming through on an gun related issues.

The sides are already set, You might get a few more points of show out but thats it.

The questions that remain to be answered are the following

Who is more motivated to vote this go round, people who are tired of the lock downs and riots or the typical person that you are seeing posting online about RGB but could not be bother to ever read one of her opinions.

If it were me, I would ram one through by Friday, one can not assume reelection or keeping the senate.

The sides are already set, You might get a few more points of show out but thats it.

Pretty much this. It's not like there were already a large pool of undecided moderates who were thinking about breaking for Trump but who would be offended by an attempt to push through a SC nominee. Sure, maybe there are a handful on the margins who get turned off/on by this specific issue and maybe they are all in swing states where they could tip the electoral college, but that's also true of:

    1) any number of issues that could be discussed between now and the election;
    2) shenanigans potentially played by both sides and foreign actors to swing the vote via legal and illegal mechanisms
    3) just plain ol' random human behavior dictating who does and doesn't show up to vote (or mail a ballot)

For a campaign season that has already been such a shitshow, it'd be stupid for the Trump team to play a game of political calculus. My take is simple - if there is any chance of a nominee getting through the Senate, go for it with zero fucks given.

Both important. The next 4 years will bring 2 more vacancies (Bayer and Thomas). If Biden wins, it will
Be a progressive majority by the end of his first term.

In reality, there shouldn’t be a SCJ that has a favoring to a party, as it should just do it’s fucking job....but that’s not reality. That said, a SC seat is more important for the nation than a figure head.

@TheHorta - do you really want a “conservative” or just a good Constitutionalist?

While I am conservative, I am a fan of an apolitical SCOTUS that is actually living up to their job.
the COTUS without any perversions is pretty darn good as far as conservative thinking goes.

That’s the ideal. Unfortunately, that hasn’t been the reality for decades now, probably a century or more.

Part of the problem is how the SCOTUS is formed. First, presidents should not be picking SCOTUS candidates. They will always be skewed toward one side. Second, a SC Justice wields incredible power. It’s the only branch that can reign-in BOTH of the other branches. We’ve seen clearly how political the SCOTUS has become — every major decision is split straight down party lines.

Hate it, but SCOTUS as a whole is a political tool and has little regard for the Constitution. It has been this way for generations. The last holdout was Scalia.

Trump won't get his pick through, he will lose and the Dems will add more justices. You can bet on it.

If Trump gets his pick but looses the election, the Demonrats will pack the court. No matter what, this country is fucked if Binden wins.

I don't disagree, but considering the all the abuses of authority that has come out of the big government party say dating back to the IRS scandal, the DOJ using bad Fisa's to investigate a political opponent, The house investigations and impeachment over questions about the the players in that probe, The lock downs and shuttering of the economy in blue states because of a new flue bug, Democrat Mayors and citi governments making zero effort to reign in riots, while democrat donors set up a system to ensure that anybody that gets arrested is quickly bail out.

Do we really think that Democrats would not consider packing the court if they had the votes.
Do we really think that Democrats would not of banned all semi auto guns in 94 if they had the votes.

I do not think that all is lost, if Biden wins. I think that in order to do the most damage they need 60 votes in the senate and even if the republicans lose their majority, they will not have a super majority.

Its the same reason that we could not get national reciprocity or a modification to the NFA.

I think the Biden administration leads to the same economy that Obama had, where they did foreign relations/diplomacy via sending US jobs overseas.

Of course, I would like nothing more than to see trump win in November but its not going to be the end of the world. Even if they do ban guns, I really didnt pay much mind to the last one, Imagine I wont pay much mind to the next one

At this juncture I think both are equally important as has been stated by the people above. This is really the last chance conservatives have to make a difference. This new generation has been brainwashed to be liberal and once the boomers are starting to die off the pendulum of the country will swing super far left.

The election is much more important. After he is elected for his second term, Trump can then nominate a replacement for RBG and possibly 1 or 2 additional justices in the next 4 years. The only caveat is the Rs must keep control of the Senate.

You also have to think of all of the lower court appointments Trump will be responsible for as well.

I think if we go for a pre Nov 3rd appointment, we will wake the Demwits and have a chance to lose the election and possibly lose the Senate. At this time, the Demwits are just lukewarm with supporting Hiden Biden. But if we try to appoint an RBG replacement, I'm really afraid we will win the battle but lose the war.

I love how the left immediately portrays it as one or the other. Do you really think anyone who is voting for Trump over Biden wants Biden to have a chance to nominate some wacked out leftist like RBG? ITs funny their go to argument is, "they will stop people from murdering babies." The sad part is it works.

I will say that the Supreme Court would have a hell of a lot less power if Congress would do its fucking job and legislate. Since they won't do their job, we're stuck watching the President rule by executive order and adminstrative rulings, and the SC rolling back those actions.

Trump is going to win in a massive landslide. I don't believe the polls. I see with my eye's the number of Trump supporters in boat parades, in his personal appearances, the energy. I just got back from Florida, Destin and Trump stuff is for sale everywhere. He will get the highest number of black votes this country has ever seen for a Republican and also the Spanish vote. I just see a landslide coming.

I do think Trump needs to nominate a justice immediately! It's his duty and the duty of the Senate to support him. Anyone who does not support Trump in the Senate will be voted out next time around. Romney better grow some nuts this time. Trump still has 4 1/2 months left on this Presidency and he would be derelict of duty not to nominate immediately. We can not have a lame duck 4-4 Supreme court.

Get out and vote in person for Trump. Get everyone you can to get out and vote and we must all convince a few of our liberal friends, acquintances to do the same. We got a Black American friend of ours to actually join the NRA or we wouldn't take him shooting. Now he wants to buy his first gun and we told him he has to vote for Trump, because Biden will just come take it away anyway. I think we might have him convinced. If 5 million gun owners got on Democrat to vote Trump, game over. Get off your asses and start talking to a Democrat into votine for Trump! Sitting around talking to your friends who are already voting Tump is just a big circle jerk.

I’m thinking that we have to keep the Supreme Court Republican. I believe that it would make it a lot harder for the dick heads to get rid of the 2nd amendment. Man that’s a tough one.

The SC should be politically neutral. There's a reason why the framers didn't make the SC justices an elected position. Unfortunately, respecting and honoring the Constitution as written is now considered a "far right" idea. A rational person would ask themselves what radical laws are the Dems are trying to implement if they need to pack the SC to do it....

The SCOTUS should interpret laws on the basis of the Constitution.

They should not legislate from the bench. Period.

The 'pejorative' term is originalists. Well, every SCOTUS justice should be looking at every case, every law, everything sent there way through the lens of the Constitution and the Bill of Rights. NOT making crap up based on their commie/liberal/socialist BS personal feelings.

That is what the SCOTUS needs to be. Not left. Not right. Originalist. It's NOT a bad word. It's what was intended.

Apart from the criminal justice reform bill (instigated by non other than Kim kardashian of all people) and the appointment of federal judges and Gorsuch and Kavannagh on the Supreme Court, there is little of the trump admin that will be enduring (other than all those dead Americans from COIVD). It is totally worth it to lose the whitehouse in order to get a Conservative judge in. This would safeguard, as much as it is possible, a lot of the fundamental elements of our Constitution against the idiocy and rise of the extreme left.

If trump manages to get 3 SC judges appointed then that's a worthy contribution in itself and he would have earned an extra Happy Meal with his Big Macs and Fries...
