It would depend on the circumstances, and witness statements. Auto policies have specific language that criminal and intentional acts are not covered. They cover drunk driving accidents, even though criminal, because it is an impaired criminal act. The person in the black car should not have physical damage coverage for their own car but their liability coverage would cover the damage to the truck. The person in the black car could also be charged for ADW.

In a case like this if the claim was denied for cause the insurance company also has an obligation to protect the lien holder. They would notify the lien holder the damage exists and the claim was denied due to being an intentional act. The lien holder would then immediately call the loan or repo the car. Once the lien holder was in possession of the car they would invoke the lien holder protection clause and the insurance company would have to repair or total the car. Once the car was totaled or repaired and sold the person would still owe the lien holder the difference between the settlement price or sale price and what was owed on the loan.

Incidents like that are why everyone should have cameras in their vehicles.
